(2) The approval of a preliminary plat indicates that the subdivider may proceed toward <br />fulfilling the necessary steps for approval of the final plat in accordance with the terms of <br />approval. <br /> <br />It is expected that the applicant will work towards meeting all conditions of approval. <br />Prior to final plat approval the applicant must have complied with all conditions. The <br />preliminary plat is valid for 12 months following Council approval. <br /> <br />(3) No plat will be approved for a subdivision which covers an area subject o periodic <br />flooding or which contains extremely poor drainage facilities and which would make <br />adequate drainage of the streets and lot impossible. <br /> <br />The property is located on Long Lake, where a floodplain does exist. The applicant has <br />submitted a preliminary grading plan that shows the proposed homes to be above the <br />floodplain. Also, the applicant’s preliminary storm sewer plan shows a storm water pond <br />will be constructed on lot 1, block 1. Additionally, the Rice Creek Watershed District will <br />require a permit for construction of the new homes. The purpose of the RCWD is to <br />ensure this condition is met. <br /> <br />INTEROFFICE ENGINEERING/PUBLIC WORKS COMMENTS <br /> <br />A memo dated February 11, 2015 from Community Assets & Development Director Craig <br />Schlichting discusses the Engineering/Public Works elements to this subdivision request. The <br />applicant will be required to incorporate these comments into the final construction drawings, to <br />be approved by the City Engineer. <br /> <br />STAFF RECOMMENDATION <br />Staff recommends approval of the Preliminary Plat, known as ECKSON, subject to the following <br />conditions: <br />1. The applicant shall file for final plat approval within 12 months of the date of Council <br />approval of the preliminary plat. <br />2. At the time of final plat submittal the applicant shall pay park dedication fees for three <br />newly created lots, amounting to $5,160 (3 x $1,720). <br />3. Incorporation of the comments contained within the Interoffice Engineering/Public Works <br />memo dated February 11, 2015. <br />4. Prior to final plat approval the applicant shall remove the encroachments on lot 1, block 2 <br />including two sheds and a fence. <br />5. Prior to final plat approval the applicant shall remove the encroachments on lot 1, block 1 <br />which include the driveway located on the west side of the lot. <br />6. Prior to final plat approval the applicant shall remove the existing home located at 1333 12th <br />Ave. NW. <br />7. A permit from the Rice Creek Watershed District shall be submitted in conjunction with a <br />building permit for proposed lot 1 block 1, and for lots 1, 2 and 3 on block 2. <br /> <br /> <br />Mark Andrle, Community Assets & <br />Development/GIS Specialist <br />
