Director of Community Assets & <br />Development/Planning Director <br />SUBJECT: Follow -Up — March 24th Urban Farming Work Session Discussion <br />Based on the discussion that occurred at the March 24th work session, staff offers the <br />following additional information: <br />• The draft ordinance has been revised to reflect the Council's direction on <br />minimum coop setbacks (see Section 6 -203, paragraph 5). This has been drafted <br />in a manner than enforces the most restrictive of four different setbacks. It should <br />be noted the City Attorney was unavailable to review this prior to posting the <br />packet. As such, minor word changes may be necessary but the overall impact of <br />these standards will not be changed. <br />• Staff did not revise any section of the ordinance that pertains to a maximum coop <br />size. The minimum coop size of 3 SF per fowl remains (Section 6 -202). <br />• The chart in Section 6 -201 regarding the number of fowl allowed is unchanged. <br />• To address concerns that a 25' setback from residences could effectively ban <br />coops, staff prepared some examples illustrating that even in downtown New <br />Brighton, where lots are significantly less than the minimum 10,000 SF, space <br />still remains for a coop. It should be emphasized that staff's understanding from <br />the work session discussion was the 25' setback would be from residences and <br />not all structures (such as detached garages and sheds). <br />• Council should discuss whether they want to allow a "grace period" for residents <br />to come into compliance with the ordinance and if so, what the appropriate <br />amount of time is. This provision hasn't been discussed but is included in Section <br />3 of the proposed ordinance. <br />Staff also understands that several concerns have been voiced regarding whether the <br />proposed standards are either too restrictive or not restrictive enough. In an effort to <br />move toward a conclusion on this topic, and /or to provide perspective, staff offers the <br />following information: <br />
