This additional outdoor storage use, when combined with the existing outdoor storage <br />needs, results in a land use intensity too great for the environmentally sensitive area or <br />Rush Lake and Long Lake Regional Park. <br />10. The Planning Commission recommends denial of the request to calculate pile storage <br />allotment based upon total site area, based upon the following findings: <br />a. A pile storage increase of 83% isn’t consistent with the intent under the original ECOA to <br />limit pile storage intensity due to 40’ pile height allowances, pile visibility from <br />surrounding property, and general unsightliness. <br /> <br />NOW THEREFORE BE IT RESOLVED, that based upon the above Findings of Fact the application <br />for a Zoning Code Amendment (ZA2014-001), Site Plan (LP2014-005), and Special Use Permit <br />(SP2014-005) are hereby recommended for approval, subject to the following conditions: <br />1. The expansion shall be consistent with the submitted Site Plan, except that the 100’ x 100’ <br />salt storage shed is removed. <br />2. An annual inspection on or within 30 days of July 15th shall be required to ensure compliance <br />with the Environmental Constraint Overlay Area conditions. <br />3. Allowed pile storage shall be based upon 30% of the area noted for pile storage on the Pile & <br />Equipment Storage Map (attached to this memo). This equates to 30% of an 11 acre pile <br />storage area, or 8 acres of pile storage allowance. <br />4. Rail cars shall not be stored on the 1000’ rail siding for more than 110 days per calendar year <br />and materials stored within the cars shall be limited to black dirt, bituminous, concrete, and <br />other processed aggregates associated within the aggregate crushing/recycling and associated <br />materials storage and excavation (Belair Excavating) uses at 2200 Old Highway 8 NW. The <br />applicant shall keep a log of days, including loading and unloading times, which shall be <br />made available for review during the annual inspection. <br />5. The Ordinance does not include the [bracketed-shaded] language proposed by the applicant. <br />6. The approximate 130’ x 656’ segment of expansion property within the ECOA extending <br />west from Old Highway 8 NW to the applicant’s proposed 8’ vegetated berm (at the east end <br />of the “Belair Construction Equipment & Supply Storage” area) shall be preserved in its <br />current condition to provide an adequate buffer between Old Highway 8 NW and the pile and <br />equipment storage areas. <br />7. The berm located at the east boundary of the “Belair Construction Equipment & Supply <br />Storage” area depicted on the Site Plan shall be at least 8’ in height and be vegetated (not <br />constructed of rubble). <br />8. The applicant enters into an Encroachment Agreement concerning the storm sewer that runs <br />across a portion of their property.
