PLANNING COMMISSION PROCEEDINGS <br />Regular Meeting — March 17, 2015 7:00 p.m. <br />Present: Chairperson Bruce Howard, Commissioners Paul Banker, Steve Danger, Marvin Deick, Susan Erickson, Erin <br />Nichols - Matkaiti, and Verne McPherson <br />Absent: None <br />Also Present: Janice Gundlach- Assistant Director of Community Assets & Development /Planning Director, and Gina <br />Bauman - Councilmember <br />Agenda Review: There were no changes to the agenda. <br />Minutes from February 17, 2015: <br />Motion by Commissioner Danger, seconded by Commissioner Erickson, to approve the February 17, 2015 meeting <br />minutes as presented. <br />Approved 7 -0. <br />Council Action: Councilmember Bauman provided an update from the Cable Commission. She noted CenturyLink has <br />submitted a request to franchise and would be offering a triple -play option to residents called Prism. She highlighted the <br />features CenturyLink would be offering their customers. She reported the City Council would be holding an offsite <br />meeting at Applewood Point on April 28`x'. She explained the Council changed polling districts at their last meeting and <br />noted the precincts would be changing for the upcoming election. Information would be communicated to the public prior <br />to this fall through newsletter articles and mailers. <br />Public Hearing: <br />(A) The Bru House requests a Special Use Permit and Nonconforming Use Permit to install a drive -thru <br />facility at 1431 — 1441 Silver Lake Road. <br />Assistant Director of Community Assets & Development/Planning Director Janice Gundlach reported the applicant <br />requests consideration of a special use permit in order to install a drive -thru facility at 1431 Silver Lake Road. <br />Additionally, a nonconforming use permit is required because existing parking lot setback requirements do not comply <br />with current standards. The applicant currently operates The Bru House at 1431 Silver Lake Road, which is the most <br />westerly tenant space of the multi- tenant commercial building at 1431 — 1441 Silver Lake Road, which is owned and <br />managed by Kraus Anderson. The applicant wishes to install a drive -thru at the east end of the building, in a space that is <br />not contiguous with the current coffee shop. The applicant would install a drive -thru lane, improve a new 12.5' x 36' <br />tenant space at the east end of the building only for drive -thru customers and not otherwise open to the public, and install <br />a drive -up menu board and pick -up window (with lights) on the east building fagade. In accordance with Section 11 -020 <br />(10), a special use permit must be obtained in order to implement a drive -thru facility. <br />Planning Director Gundlach explained the site, building, and parking lot were developed prior to existing Zoning Code <br />requirements. Based upon aerial photos dating to 1974 (a date within 5 years of initial construction), the site was <br />developed in the manner that exists today. As such, there are several parking standards that do not meet current <br />requirements, including: <br />• A front yard parking lot setback less than the required 30' <br />• Side yard setbacks (north and south) less than the required 5' <br />• A rear yard parking lot setback less than the required 25' <br />
