Planning Director Gundlach indicated because of these nonconformities, the applicant must secure approval of a <br />nonconforming use permit in order to improve the property with a drive -thru facility. The purpose of the nonconforming <br />use permit is to determine if the nonconformities can be practically reduced and/or eliminated. <br />The applicant has met with staff several times over the years regarding her desire to implement a drive -thru facility for her <br />coffee business. Several discussions were had concerning a drive -thru space that was contiguous with her current <br />operation at the west end of the building. However, the applicant could not meet minimum drive -thru standards under <br />those scenarios. The applicant has decided to pursue to non - contiguous option, being the drive -thru is important to her <br />business. The applicant intends to only sell coffee and pre -made pastries from the drive -thru, so as to ensure swift <br />movement of traffic through the site. <br />Staff recommends approval of the Special Use Permit and Nonconforming Use Permit, subject to the following <br />conditions: <br />1. The drive -thru is constructed in accordance with the submitted plans and parameters outlined within the Planning <br />Report dated 3/11/2015. <br />2. Only coffee and pre -made pastries and the like shall be served via the drive -thru to ensure swift movement of <br />traffic through the site. <br />3. The last two parking spaces, most easterly along the row of parking facing the building, shall be designated and <br />signed for The Bru House employee parking only to ensure adequate stacking space is provided in the drive -thru <br />lane. <br />4. The drive -thru lane shall be painted on -site to ensure non - drive -thru traffic can bypass the drive -thru lane and exit <br />the site. <br />5. Sound from the drive -thru speaker shall not be audible at adjacent residences. <br />6. Should residents of the townhomes to the east complain to City staff of lighting or noise disruptions related to the <br />drive -thru, the applicant shall be required to construct a 6' privacy fence along the eastern, north -south property <br />line. Upon receiving more than one compliant, City staff shall notify the applicant by letter of the need to comply <br />with the Special Use Permit by constructing the fence. Failure to construct the fence shall constitute a violation of <br />the Special Use Permit, subjecting the applicant to revocation of the special use. <br />7. The applicant shall re -paint the parking stalls abutting the eastern, north -south property as angled parking, <br />providing an 18' one -way drive -aisle width between the stacking lane and the angled parking so as to comply <br />with Zoning Code Section 11 -020(7 & 8). <br />8. The applicant shall be permitted to open the drive -thru lane at 6am. The drive -thru shall close in accordance with <br />the requirements of Section 11- 020(10) (H). <br />9. Proposed lighting shall be directed downward and shielded per Section 11- 010(6). <br />Commissioner Erickson asked if cars would be able to maneuver around the angled parking near the rear of the building. <br />She questioned where snow would be stored in this portion of the parking lot. Planning Director Gundlach explained the <br />site plan submitted shows the sidewalk would be removed which would provide additional space for parking. She <br />understood the space would be tight but staff believed that the primary drive -thru hours would not unreasonably interfere <br />with the adjacent tenants. <br />Commissioner Erickson expressed concern with how the intersection at Silver Lake Road would be impacted by the <br />proposed business. Planning Director Gundlach discussed the traffic situation at this intersection and noted the Public <br />Safety Department did not have any concerns. <br />Lynn Barton, Bru House, discussed how traffic flowed through the site. She understood it was a tight space, but noted her <br />patrons would make the time to stop for the convenience of ordering coffee each morning. She reported that 60% of <br />coffee was sold through drive -thru windows and she was hoping to capture some of this business. <br />Commissioner Danger inquired how the drive -thru would be arranged. Ms. Barton explained that she would have two <br />windows, one for taking orders and the other for delivering drinks. She was excited about how this new amenity would <br />positively impact her business. <br />2 <br />
