Commissioner McPherson stated that based on the documents presented, he believed it may be difficult for the <br />City to enforce the storage or rail cars. He recommended that the language within the development agreement <br />be revised to ensure that the applicant does not allow his rail area to become a for profit rental space. <br />Commissioner McPherson recommended that the pile storage language within Condition 2 remain as is, <br />however, he was in favor with amending Condition 1. <br />Commissioner Deick was not comfortable with Condition 1. He wanted to see a fully contained building for the <br />salt. <br />Commissioner Danger recommended a berm on the east side of the property be considered to assist with <br />screening the view from Old Highway 8. <br />Chairperson Howard discussed Condition 4 and asked if the Commission supported the proposed increase as <br />proposed by the applicant. The Commission was not interested in amending this condition. <br />Commissioner McPherson was in favor of allowing up to 10,000 square feet of road salt storage on the Belair <br />site. <br />Chairperson Howard believed that the proposed amendments would allow for road salt storage as proposed by <br />the applicant. Planning Director Gundlach recommended that the Commission provide further clarity as to how <br />the salt storage sales should occur. City Attorney LeFevere advised that the Commission provide direction on <br />the parameters with which the salt sales can occur. <br />Commissioner Deick still wanted to see rolling doors on the fourth side of the salt storage shed. <br />Commissioner McPherson suggested that Item A require the shed to be covered on four sides, including a roof <br />and Item C should have a maximum of 13,500 tons annually. <br />Motion Amendment: Motion by Commissioner Nichols - Matkaiti, seconded by Commissioner <br />McPherson, to amend Item A requiring the shed to be covered on four sides, including a roof and Item C <br />which would require the applicant to have no more than 13,500 tons of road salt annually, noting the salt <br />storage shed shall be no more than 10,000 square feet, and to not allow the applicant to store rail cars on <br />the siding for profit. <br />Amendment Approved 4 -2 (Danger and Chairperson Howard opposed). <br />Amended Motion Approved 6 -0. <br />Public Hearing — New Business: <br />(A) Pratt Ordway Properties requests consideration of an amendment to a previously approved <br />Planned Unit Development and a Special Use Permit to allow construction of an outdoor dining <br />deck for The Exchange Food & Drink located at 500 Stn Avenue NW, Suite 105. <br />Planning Director Janice Gundlach reported the applicant is requesting a Planned Unit Development (PUD) <br />Amendment and Special Use Permit to permit construction of an outdoor dining deck at 500 5th AVE NW, <br />Suite 105. Specifically, the tenant space proposing outdoor dining is the corner tenant of the building known as <br />Building E within the Main Street Village mixed use development. The existing tenant is The Exchange Food & <br />Drink, which is located at the northwest corner of 5th AVE NW and 5th Street NW (also known as County Road <br />E2 Extension), with the outdoor dining deck facing this intersection. <br />Planning Director Gundlach explained the deck would be 956 sq. ft. and accommodate seating for 50 occupants. <br />The deck would be constructed of treated lumber framing and the decking would be a composite material. It <br />would be surrounded by a 42" railing, the underside would have lattice screening and a gas fire pit is proposed <br />in the middle of the dining area. A PUD Amendment is required as the entire Main Street Village development <br />was approved through a PUD dating back nearly 14 years. Any changes to approved PUD's require review and <br />9 <br />
