Mr. Murlowski stated staff was recommending an 8 acre storage area while he was requesting an 11 acre site. <br />He discussed the history of the property noting the areas below the high power transmission lines were virtually <br />unusable. He indicated that the salt sales would assist him in keeping his business vibrant through the winter <br />months. <br />Jim Yosh, representative for Murlowski Properties, discussed the coverage area and how it would impact health, <br />safety and public welfare. He noted that the applicant was requesting 11 acres of additional storage, which <br />would mean just under half of the site would be used for outdoor storage. He appreciated the Commission's <br />time and encouraged the Commission to consider the applicant's request as submitted given the fact there was <br />such a slight difference between 8 and 11 acres. <br />Sandy Holzer, 1283 Mississippi Street, discussed the view from her house. She did not appreciate the large <br />wall that was constructed and asked how she would be further impacted through the proposed expansion of the <br />Belair site. Planning Mr. Murlowski discussed which rail lines would be used noting he was not proposing to <br />have rail cars run by Ms. Holzer's home. <br />Betty Funk, 1112 Rockstone Lane, expressed concern with how pedestrians on the trail would be impacted <br />visually and by sound through the proposed expansion of the Belair site. She did not want to see the trail <br />compromised by increased noise. Planning Director Gundlach reported that staff was concerned by the noise <br />that would be generated from hooking and unhooking the rail cars. She understood that noise from Belair has <br />been a concern. She explained that staff was unaware of how the new use would impact the surrounding <br />property. She commented that the berm and wall would remain in place and the site would have to remain at 56 <br />decibels. <br />Mr. Yosh recommended that language be included in the Special Use Permit that would clarify that the piles <br />would be no more than 40 feet. He explained that this would be the same height that was previously approved <br />by the City. He stated that all State noise standards would have to be followed through the expanded use. He <br />reported that the salt sales would occur in the winter months, when windows on adjacent homes were closed. <br />Mr. Murlowski added that he anticipated that only five rail car deliveries would be made over a five month time <br />period. <br />Commissioner Nichols - Matkaiti inquired if the 110 day time period was clearly defined within the development <br />agreement. Planning Director Gundlach stated staff would address this language further. <br />Commissioner Danger asked how trains would enter and exit the property. Mr. Murlowski anticipated that the <br />cars would be pushed in by an engine and the engine would then return after the rail cars would be off loaded. <br />Commissioner Deick questioned who would be constructing the railroad spur. Mr. Murlowski noted that he <br />would be constructing the railroad spur at this expense. <br />Motion by Commissioner Nichols - Matkaiti, seconded by Commissioner McPherson to close the Public <br />Hearing. <br />Approved 6 -0. <br />Chairperson Howard stated he appreciated the discussion held this evening and he appreciated the thorough <br />presentation provided by staff. He recommended that the Commission take action on the item as presented by <br />staff and offer any amendments, where necessary. <br />Motion by Commissioner McPherson, seconded by Commissioner Nichols - Matkaiti, to recommend <br />approval of the Zoning Code Amendment, Site Plan and Special Use Permit, subject to 12 conditions. <br />Commissioner Nichols - Matkaiti questioned if the berm height should be increased to ten feet as proposed by the <br />applicant. <br />8 <br />
