May 26, 2015 Page 5 of 11 <br />Mayor Jacobsen asked if fines were associated with the citation. Assistant Director of Community Assets and <br />Developmentl1'1 anning Director Gundlach was not aware of fines being apart of the citation process, unless <br />ordered by the Court <br />Councilmember Burg questioned if a license could be revoked for non- compliance. Assistant Director of <br />Community Assets and Development/Planning Director Gundlach reported this would be an option for the <br />City, noting it may be difficult to bring the property into compliance. City Manager Lotter stated that a case <br />against a non -comp] iant property may receive a better judgement from the courts. <br />Councilmember Bauman understood that one resident was keeping chicks in his home. She wondered how <br />staffwould be able to see if this resident was complying with the Ordinance. For this reason, she supported a <br />total ban on fowl. <br />Mayor Jacobsen feared how staff would be burdened and impacted through the enforcement of this <br />Ordinance. He was concerned with the fact that the State would not have fowl displayed at local County and <br />State fairs. He was not comfortable making decisions that could be altered by the State and federal <br />govemnnent. <br />AMENDMENT: Motion by Councilmember Jacobsen, seconded by Councilmember Strub to amend <br />Ordinance 834 to require existing fowl owners to register with the City within 90 days after the <br />Ordinance is passed and published; and requiring future fowl owners to register immediately with the <br />City. <br />3 Ayes, 2 Nays (Bauman and Mayor Jacobsen opposed }Amendment Carried <br />AMENDMENT: Motion by Councilmember Strub, seconded by Councilmember Burg to amend <br />Ordinance 834 to allow no outdoor butchering of fowl. <br />Mayor Jacobsen explained that the proposed language would still allow chicken owners to slaughter chickens <br />within an enclosure. He believed that the slaughtering and disposal of chickens did not belong in New <br />Brighton. <br />Councilmember Strub discussed the processing of putting down a family pet and did not believe that residents <br />should have to drive into Mounds View in order to slaughter a chicken. <br />Councilmember Bauman understood it was a slippery slope addressing the slaughtering of chickens. She just <br />feared that disease could be spread through the animals and carcasses. She called the question. <br />3 Ayes, 2 Nays (Bauman and Mayor Jacobsen opposed)- Amendment Carried <br />3 Ayes, 2 Nays (Bauman and Mayor Jacobsen opposed)- Amended Motion Carried <br />Consideration of Ordinance 832, Resolution approving a Zoning Code Amendment, Site <br />Plan, Special Use Permits, and execution of a Land Use Agreement facilitating a 17 -acre <br />expansion and introduction of a salt storage and transfer use at 2200 Old Highway 8 NW. <br />City Manager Lotter indicated Assistant Director of Community Assets and Development/Planning Director <br />Gundlach would be presenting this item to the Council. <br />Assistant Director of Community Assets and Development/Planning Director Gundlach reported that since <br />the April 28th City Council meeting, staff has met with the applicant to discuss a variety of operational <br />impacts of the proposed salt storage and transfer facility use. Staff advised the applicant to prepare an updated <br />narrative and grading plan for the proposed salt shed. Those items are attached The applicant has also <br />submitted a scope of services letter from Braun lntertm regarding an Environmental Stonnn Water Sampling <br />Program proposed to address the environmental concerns raised byline residents of Applewood Pointe Senior <br />Cooperative. <br />Assistant Director of Community Assets and Development/Planning Director Gundlach stated based on the <br />3.
