8) The applicant secures all necessary permits from other state and/or federal authorities for use <br />of the helipad, including but not limited to the Federal Aviation Administration and <br />Minnesota Department of Transportation. <br />This criterion is met. The applicant has indicated they've applied for the necessary permits <br />from the FAA and MnDOT. As a condition of approval, the applicant will be required to <br />submit copies of those secured permits to City staff. <br />9) Because every property has a unique set of characteristics with regard location of buildings, <br />landscaping, and topography, the City Council may impose other conditions not specified <br />herein that are deemed necessary to mitigate any negative impacts resulting from use of the <br />helipad. <br />Based on review of the Building Official and Fire Marshal, the applicant will be required to <br />comply with the Building Code and Fire Code. This includes complete removal of the old <br />building foundation as the Building Code states that nothing larger than I cubic foot in area <br />shall be buried on site. This material shall be disposed up at an approved solid waste <br />landfill. Being it is no longer the intent of APi to preserve their option to build the 9000 SF <br />building, nor are they contractually obligated to build that building, the foundation shall be <br />removed in its entirety. <br />Additionally, the applicant will have to work with the Fire Marshal to ensure compliance <br />with helipad standards of the Fire Code. This includes submission of an Emergency <br />Response Plan, access/egress standards, no smoking signs, and proper helipad grading to <br />ensure fuel leaks are directed away from access/egress points and passenger holding areas. <br />No additional conditions beyond these have been noted at this time. <br />10) Special use permit procedures of Sections 8-120 and 8-220 shall be followed except that <br />public hearing notice shall be mailed to each property owner within 1000' of the property <br />under consideration. <br />This criterion has been met. 42 notices were mailed to property owners within 1, 000' of the <br />proposed helipad site. As of the drafting of this report only one inquiry had been received, <br />with no opposition to the project. <br />11) Compliance with the special use standards of Section 8-130. <br />These standards are examined in the next section below. <br />Based on the above analysis, staff finds the standards of Section 6-693(C) are met, subject <br />to conditions. <br />In addition to the proposed special use standards of Zoning Code Section 6-693 (C), Section 8- <br />130 states that no special use shall be recommended by the Planning Commission unless it shall <br />find (staff responses in italics): <br />1) That the establishment, maintenance, or operations of the special use will not be detrimental <br />to or endanger the public health, safety, morals, comfort or general welfare. <br />
