<br />Page 3 - August 09, 2005 New Brighton Council Minutes <br /> <br />Mayor Larson, and Council Members Doffing and Burg complimented staff on <br />IrOdUCing a fair and consistent plan. <br /> <br />om Siwek 6570 Fridley St NE questioned the issue of current non conformities. <br /> <br />The City Planner indicated that non-conformities are permitted provided the <br />footprint of the parcel is not changed. <br /> <br />Mayor Larson requested clarification from the City Attorney. <br /> <br />The City Attorney stated a variance would be required to build on a non-conforming <br />lot. <br /> <br />The City Attorney clarified the various ways the grandfather rules are applied, <br />indicating that this application did have the legal basis to be "grandfathered." <br /> <br />Mayor Larson asked if anyone else wished to speak to the issue. <br /> <br />A resident in the near vicinity of Mr. Siweks property stated her concerns regarding <br />the lot irregularities. <br /> <br />Mayor Larson again asked if anyone else wished to speak. <br /> <br />lotion by Council Member Hoffman, seconded by Council Member Burg to close the <br />blic Hearing. <br /> <br />Motion by Council Member Doffing, seconded by Council Member Burg to adopt the <br />attached ordinance amending section 4~140 of the City Code, and direct staff to <br />publish the text in the New Brighton Bulletin. <br /> <br />Council Member Moore-Sykes expressed her opposition to the amendment to the <br />ordinance, stating that this ordinance change will be of no benefit to the current safety and <br />crowding issues, in addition to resulting in non conforming situations for many residents. <br /> <br />3 Ayes - 2 Nays, Motion Carried <br /> <br />Council Business <br /> <br />1. Consideration of a lot split for 557 5th Avenue NW. This item was tabled at <br />the July 12th, 2005 Council Meeting. Report No. 05-178 <br /> <br />te City Planner recapped the timeline relating In this item. <br /> <br />The City Planner explained that the three proposed lots would not all meet the <br />amended zoning code. <br /> <br />It was the recommendation of the City Planner to deny the request. <br /> <br />ouncil Business <br />1.
