SPECIAL USE PERMIT ANALYSIS <br />Section 6-140(2) lists truck and trailer repair and sales as specially permitted uses in the I-2, <br />Heavy Industrial zoning district. The owner of the property secured a special use permit in 2003 <br />for the truck and trailer repair use. The current proposal is to add truck and trailer sales, which <br />requires review and approval of a new special use permit. Beyond the site plan standards <br />discussed above, all special uses must comply with the following standards of Section 8-130 <br />(staff responses in italics): <br />No special use shall be recommended by the Planning Commission unless it shall find: <br />(1) That the establishment, maintenance, or operations of the special use will not be detrimental <br />to or endanger the public health, safety, morals, comfort or general welfare. <br />Staff finds this criterion to be met. The truck and trailer sales use will be complimentary to the <br />existing truck and trailer repair use. Additionally, the site does not have any frontage on a <br />public roadway. The site does abut I -35W, which allows the applicant to obtain visibility needs <br />for a sales use without negatively impacting views from public streets. Lastly, the applicant will <br />implement several improvements to the site that will overall have a positive impact and improve <br />the conditions from what exists today. This includes maintaining a cleaner and orderly <br />parking/display lot as depicted in the supplemental narrative and on Sheet L1-1: Rendered <br />Landscape Plan. Collectively, these items will ensure the use will not be detrimental to or <br />endanger the public health, safety, morals, comfort, or general welfare. <br />(2) That the special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and impair <br />property values within the neighborhood. <br />Staff finds this criterion to be met. The applicant is investing substantially into the site to <br />improve its overall appearance and function. The applicant's sales brand of Truck County will <br />ensure a more orderly and clean site than exists today, including the keeping of a well <br />maintained used truck and trailer sales stock. This effort will have a positive impact to the <br />neighborhood and will not negatively impact enjoyment of surrounding properties or diminish <br />property values. <br />(3) That the establishment of the special use will not impede the normal and orderly development <br />and improvement of the surrounding property for uses permitted in the district. <br />Staff finds this criterion to be met. All the surrounding uses are zoned I-2, Heavy Industrial and <br />contain existing heavy industrial uses including truck and trailer repair, towing, and storage <br />uses. The proposed use will act in harmony with these existing uses and not negatively impact <br />the surrounding area. <br />(4) That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />Staff finds this criterion to be met. The applicant will utilize existing roadways and private <br />driveways and not negatively impact other users of these access roads. The applicant will be <br />improving the parking lot and controlling drainage on site. The applicant will be improving <br />access to utilities, installing additional lights for security and bringing fiber optic cable through <br />
