RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN, SPECIAL USE PERMIT, AND <br />NONCONFORMING USE PERMIT. <br />WHEREAS, an application has been made by Jason Grawe on behalf of McCoy Group, Inc. (aka <br />Truck Country) to introduce truck and trailer sales to the existing truck and trailer repair use, <br />including various site improvements at 2015 1h AVE SW, and, <br />WHEREAS, the procedural history of the application is as follows: <br />1. Applications for a Site Plan, Special Use Permit, and Nonconforming Use Permit were <br />received on October 30, 2015. <br />2. A public hearing notice concerning the request was published in the November 6, 2015 <br />edition of the New Brighton area Sun Focus. <br />3. Public hearing notices were mailed to property owners within 350' of the property on <br />November 5, 2015. <br />4. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on November 17, 2015 and all present were given a chance to freely speak at the hearing. <br />5. The Planning Commission recommended conditional approval on November 17, 2008. <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the Site <br />Plan (LP2015-003), Special Use Permit (SP2015-008), and Nonconforming Use Permit <br />(NC2015-002): <br />I . The property is zoned I — 2, Heavy Industrial. <br />2. The property is guided in the Comprehensive Plan for HI, Heaving Industrial. <br />3. The applicant is proposing to introduce truck and trailer sales to the existing truck and trailer <br />repair use, including various other improvements to the site. <br />4. The Planning Commission considered the Site Plan in accordance with I - 2 district standards <br />of Section 6-150, the commercial performance standards of Section 6-390, and the parking <br />standards of Chapter 11 of the Zoning Code. <br />5. The Planning Commission found all applicable Site Plan standards to be met based on the <br />analysis within the Planning Report dated 11/13/2015. <br />6. The applicant requested a special use permit to conduct truck and trailer sales per Zoning <br />Code Section 6-140(2). <br />7. The Planning Commission considered the following special use permit criteria of Zoning <br />Code Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />b. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />1 <br />
