Consideration of <br />Amendmentto Liquor <br />City Manager Lotter indicated Public Safety Director Jacobson would be presenting this item to the Council. <br />Code. <br />Public Safety Director Jacobson explained the City of New Brighton began exploring <br />additional liquor licensing categories based on several recent changes in State Statute. This <br />began with the "Surly Bill" in 2011 that allowed Brewer Taprooms. Subsequent states law <br />changes in 2014 and 2015 have expanded brewery and microdistillery business use including <br />expanding on sale and off sale options and allowing on sale on Sundays to begin at 8 a.m. <br />Cities can be more restrictive and are not required to create and allow these license uses. Staff <br />has reviewed the State Law changes related to alcoholic beverage sales and recommends that <br />City Code be amended to incorporate all State Law changes with highlights to include the <br />following: <br />• Allowing Brewer Taprooms On Sale - Brewers who hold a brewer's license can operate <br />on sale of malt liquor produced by the brewer on premises or adjacent to the brewery <br />location. A brewer taproom license may also have a restaurant license but is not <br />required to do so. <br />• Allowing Small Brewer Off Sales — A brewer who manufactures less than 3,500 barrels <br />of malt liquor in one year. The malt liquor must have been produced and packaged by <br />the smaller brewer. <br />• Allowing Microdistillery Off Sale — A microdistillery may sell off sale distilled spirits <br />and is limited to the hours of off sale liquor. The license would allow the sale of one <br />375-milliliter bottle per customer per day of distilled spirits. <br />• Allowing Microdistillery Cocktail Rooms (on sale) — A microdistillery may also sell on <br />sale distilled spirits produced by the distiller for consumption on premises or adjacent <br />to one distillery location. <br />• Allowing On sale of intoxicating liquors to be sold beginning at 8 a.m. on Sundays with <br />the service of food (aka Bloody Mary law) and including brewer taprooms. <br />Public Safety Director Jacobson reviewed the Ordinance in further detail with the Council and recommended <br />approval of an Ordinance amending Chapter 4 of the City Code regarding Alcoholic Beverages and a <br />Resolution authorizing staff to publish the Ordinance by title and summary. <br />Councilmember Strub asked if representatives from Barley John's could introduce themselves to the Council <br />and offer comments on the Ordinance. John Moore, Barley John's, stated he was looking forward to the <br />Sunday sales as this would improve the vitality of his business. <br />Councilmember Strub questioned when the proposed Ordinance amendments would go into effect. City <br />Manager Lotter reported that the Ordinance would become law once it was published in the newspaper, <br />which would be in approximately two weeks. <br />Councilmember Burg thanked the representatives from Barley John's for attending this evening. She stated <br />that their food was delicious and the patio was inviting. <br />Councilmember Jacobsen stated he was a fan of Barley John's as well and appreciated their input.
