Staff explained the Planning <br />Commission reviewed this matter at their October 20th meeting and recommended approval of <br />the request with conditions. <br />Peter Murlowski, applicant, thanked the Council for considering his request and explained he <br />would be more than happy to respond to questions. <br />Councilmember Stnab asked if a second building would be built on the property. Mr. Murlowski commented <br />he would not be building another building on the second lot. <br />Councilmember Sttub questioned why the applicant as proposing the improvements at this time. Mr. <br />Murlowski explained he had a new tenant that would be filling the building and requested the improvements. <br />He reported that Timber Craft would remain in New Brighton. <br />Councilmember Bauman questioned where Mr. Murlowski would be moving his business. Mr. Murlowski <br />explained he would be relocating to the Bel -Air site. <br />Motion by Councilmember Jacobsen, seconded by Councilmember Burg to Adopt a Resolution <br />approving the request as submitted subject to eight (8) conditions. <br />5 Ayes, 0 Nays -Motion Carried <br />3. Consideration of a Special Use Permit to permit auto sales from the existing building located <br />at 581 Old Highway 8 NW. <br />City Manager Lotter indicated Assistant Director of Community Assets & Development/Planning Director <br />Gundlach would be presenting this item to the Council. <br />Assistant Director of Community Assets & Development/Planning Director Gundlach reported the <br />applicant is requesting a Special Use Permit to permit operation of an automotive sales use at <br />581 Old Highway 8 NW. The use of automotive sales requires review and approval of a <br />Special Use Permit within the general business district. The tenant space proposed to be used <br />for auto sales is within the existing building and is less than 200 SF, located at the northwest <br />corner of the building. An interior wall would be constructed to create a separate office space. <br />The applicant's proposed business includes operation of office uses for sale of used, <br />reconditioned vehicles. The business would also include the keeping of no more than 5 <br />vehicles for sale at a given time to be stored outdoors on site, behind the building. The property <br />owner (Tell Ventures LLC) has designated five parking stalls on the east side of the building <br />for the applicant's use. Beyond outdoor storage of no more than five vehicles, no other exterior <br />changes to the site are proposed. The applicant's submitted materials indicate no vehicles will <br />be reconditioned on site and the impact to adjacent and nearby users would only consist of <br />outdoor parking of up to five vehicles at the rear of the building. Sales will be conducted by <br />appointment only, including online marketing. No promotion materials, such as streamers or <br />other typical dealership advertising will be displayed on the property as the applicant intends to <br />keep the business "low profile". One sign will be displayed on the building indicating the name <br />of the business. The applicant does not intend to sell any vehicles with salvage history. Staff <br />provided a full Special Use Permit analysis within the attached Planning Report dated October <br />15, 2015. Staff finds all criteria have been met, subject to the nine conditions noted in the <br />Resolution. These conditions include the allowance of no more than five vehicles on the <br />property for sale at any given time, the vehicles be licensed, operable, and in good repair, the <br />vehicles are stored in designated parking stalls out of view of the public roadway, hours of <br />operation, no use of balloons/streamers, etc. and compliance with the Sign Code. Staff <br />explained the Planning Commission reviewed this request at their October 20th meeting and <br />recommended approval of the request subject to seven conditions. <br />Lang Tell, Tell Ventures and building owner, thanked the Council for consider the proposed leasing of his <br />space. <br />Councilmember Jacobsen provided comment on the discussion held by the Planning Commission.
