Peter Murlowski, applicant, thanked the Council for considering his request and explained he would be more than happy to respond to questions. Councilmember Stnab asked if a second building would be built on the property. Mr. Murlowski commented he would not be building another building on the second lot. Councilmember Sttub questioned why the applicant as proposing the improvements at this time. Mr. Murlowski explained he had a new tenant that would be filling the building and requested the improvements. He reported that Timber Craft would remain in New Brighton. Councilmember Bauman questioned where Mr. Murlowski would be moving his business. Mr. Murlowski explained he would be relocating to the Bel -Air site. Motion by Councilmember Jacobsen, seconded by Councilmember Burg to Adopt a Resolution approving the request as submitted subject to eight (8) conditions. 5 Ayes, 0 Nays -Motion Carried 3. Consideration of a Special Use Permit to permit auto sales from the existing building located at 581 Old Highway 8 NW. City Manager Lotter indicated Assistant Director of Community Assets & Development/Planning Director Gundlach would be presenting this item to the Council. Assistant Director of Community Assets & Development/Planning Director Gundlach reported the applicant is requesting a Special Use Permit to permit operation of an automotive sales use at 581 Old Highway 8 NW. The use of automotive sales requires review and approval of a Special Use Permit within the general business district. The tenant space proposed to be used for auto sales is within the existing building and is less than 200 SF, located at the northwest corner of the building. An interior wall would be constructed to create a separate office space. The applicant's proposed business includes operation of office uses for sale of used, reconditioned vehicles. The business would also include the keeping of no more than 5 vehicles for sale at a given time to be stored outdoors on site, behind the building. The property owner (Tell Ventures LLC) has designated five parking stalls on the east side of the building for the applicant's use. Beyond outdoor storage of no more than five vehicles, no other exterior changes to the site are proposed. The applicant's submitted materials indicate no vehicles will be reconditioned on site and the impact to adjacent and nearby users would only consist of outdoor parking of up to five vehicles at the rear of the building. Sales will be conducted by appointment only, including online marketing. No promotion materials, such as streamers or other typical dealership advertising will be displayed on the property as the applicant intends to keep the business "low profile". One sign will be displayed on the building indicating the name of the business. The applicant does not intend to sell any vehicles with salvage history. Staff provided a full Special Use Permit analysis within the attached Planning Report dated October 15, 2015. Staff finds all criteria have been met, subject to the nine conditions noted in the Resolution. These conditions include the allowance of no more than five vehicles on the property for sale at any given time, the vehicles be licensed, operable, and in good repair, the vehicles are stored in designated parking stalls out of view of the public roadway, hours of operation, no use of balloons/streamers, etc. and compliance with the Sign Code.
