7. The applicant proposes approval of a Final Planned Unit Development for the 2"d and <br />3`d Additions of the Encisve at New Brighton Exchange, which consists of 28 single <br />family homes and 36 townhomes. <br />8. The Planning Commission and City Council reviewed the proposal against the PUD <br />standards of Section 7-230 and PUD criteria of Section 7-240 of the Zoning Code and <br />determined the proposed plans are in conformance with these requirements based on <br />the findings outlined in Resolution 13-076. <br />9. The proposed Final Plat is to be known as ENCLAVE AT NEW BRIGHTON <br />EXCHANGE PLAT 2 AND PLAT 3. <br />10. The Final Plat consists of creation of 28 single family lots on two blocks, 36 <br />townhome lots on two blocks, and dedication of additional right-of-way for 14`" ST <br />NW, Searles Street, and Hipp Circle. <br />11. The Planning Commission and City Council reviewed the proposed Final Plat against <br />Section 26-41 of the City Code, which establishes the data necessary for a Final Plat. <br />12. The Planning Commission and City Council determined the proposed Final Plat <br />meets these criteria, subject to review and approval of the plat by the Ramsey County <br />Surveyor. <br />Now THEREFORE BE I'r RESOLVED, that based upon the above Findings of Fact the <br />application for Final PUD and Final Plat approval for the 2"d Addition (PD2015-001, <br />FP2015-001) and Final PUD and Final Plat approval for the 3`d Addition (PD2015-002, <br />FP2015-002), to be known as ENCLAVE AT NEW BRIGHTON EXCHANGE PLAT 2 <br />AND PLAT 3 respectively, are hereby approved, subject to the following conditions: <br />1. Compliance with the conditions of Resolution 13-076, unless otherwise revised <br />herein. <br />2. The applicant executes a Declaration of Covenants & Restrictions and a Subdivision <br />Agreement for the 2"d and 3`d Additions, prior to City release of the Final Plat. <br />3. Incorporation of the Interoffice Engineering/Public Works memos dated 1/14/2015. <br />4. The 30% brick/stone standard for the townhomes, as required via the Preliminary <br />PUD, shall be eliminated. Instead, the townhomes shall be built consistent with the <br />design submitted as part of this application and include the architectural features <br />described in the applicant's written narrative, made an exhibit to this report. <br />5. The Construction Commencement dates shall be as follows: <br />a. 2nd Addition: December 31, 2015 <br />b. 3`d Addition: July 31, 2016 <br />6. The Construction Compliance date for both the 2nd and 3`d Addition shall be <br />December 31, 2019. <br />7. Review and acceptance of the plat by the Ramsey County Surveyor. <br />8. Applicant shall pay park dedications fees of $48,160 ($1,720/unit) for the 28 single <br />family units prior to City release of the final plat. If the final plat is released in 2016, <br />applicant shall pay 2016 fee rates. <br />9. Applicant shall pay park dedication fees for the townhomes at the time of building <br />permit based on current year park dedication rates. 2015 rates are $1,720 per unit. <br />10. Applicant secures a permit from Rice Creek Watershed District and submits a copy <br />for City files. <br />
