Zoning: B — 3, General Business <br />Surrounding Land Uses: <br />North: vacant business -zoned parcel — Old Highway 8 NW <br />South: business -used parcel <br />East: New Brighton Public Works Garage <br />West: business -used parcels — Old Highway 8 NW <br />SPECIAL USE PERMIT ANALYSIS <br />Zoning Code Section 5-240 (6) allows automobile sales, new or used, as a specially permitted <br />use. The proposed use will consist of a small office and the keeping of not more than five <br />vehicles for sale at any given time. Because the business will be occupying an existing space <br />there are only a few zoning related issues relevant to the Special Use Permit review. Staff has <br />determined those issues are as follows: <br />Office <br />The applicant intends to use a small portion of the existing building (approximately 200 SF) for <br />an office use related to the auto sales. Office uses are permitted uses in the B — 3 district and <br />thus do not present any zoning concerns. The applicant has indicated office hours will primarily <br />be by appointment only. Staff recommends restricting hours of operation as a condition of <br />approval in an effort to ensure adjoining uses are not negatively impacted. <br />Parking <br />The applicant has indicated a desire to store five vehicles on site during, and outside, business <br />hours. Also, the State dealer's license the applicant will acquire requires a minimum of five <br />vehicles. Staff recommends allowing no more than five vehicles for sale on site at any given <br />time. Anything more than five vehicles present a situation that appears much more like a car <br />display lot, which isn't the intent with this user or a desire of the City and wouldn't be <br />compatible with the layout of this site or adjoining uses. Existing and required parking on site is <br />as follows: <br />2,624 SF total building square footage — 10% = 2,362 SF <br />Office uses require 1 stall per 200 SF = 2,362 SF / 200 SF = 12 parking stalls <br />While the site is not currently striped, more than 12 parking stalls are available, which includes <br />the five that would be designated to the applicant's proposed use. Staff finds the site to be <br />adequately parked. Additionally, the applicant has indicated in his written narrative that most <br />sales are done via online marketing, which should not pose parking or storage problems on site <br />that might otherwise be a problem in a retail environment. Lastly, the five vehicles parked on <br />site will not be visible from a public roadway as they will be stored behind the building. <br />Signage <br />The applicant has indicated in his written narrative that a wall sign will be erected on the <br />building. Wall signs are allowed on the building facade facing Old Highway 8 NW. The <br />applicant will have to obtain a Permanent Sign Permit and comply with the Sign Code <br />requirements of Zoning Code Section 9-080(2). <br />
