DRAFT <br />5-12-15 <br />(1) On -Sale. Licenses shall be issued only to hotels and restaurants. <br />(2) On -Sale Club. Licenses shall be issued only to clubs. <br />(3) On -Sale Alicrodistillery Cocktail Room. Licenses shall be issued only to holders of <br />microdistillery licenses. <br />(4) Off=Sale Microdistillery, A microdistillery may be issued a license by the City for the off - <br />sale of distilled spirits. The license may allow the sale of one 375 milliliter bottle per custoiner <br />per day of product manufactured on-site. Off -sale of distilled spirits is limited to the hours of <br />off -sale liquor as set forth in this Chapter. No brand may be sold at the icrodistillery unless it <br />is also available for distribution by wholesalers. <br />(5) On -Sale Brewer Taproom. Licenses shall be issued only to brewers who hold a brewer's <br />license pursuant to Minnesota Statutes Section 340A.301, subdivision 6 (c). paragraph (i) or (ii). <br />(3) f6) Off -Sale. <br />(4) (77) Off -Sale Brewpub. Licenses shall be issued only to brewpubs. (Code 1966; Ord. No. <br />312, 12-26-72; Code of 1988; Ord. No. 577, 11-27-90; Code of 2001)(Ord. No. 708, 8-12-03) <br />A brewpub that holds an on -sale license may, with the approval of the Commissioner of Public <br />Safety, be issued a license by the City for off -sale of malt liquor produced and packaged on the <br />licensed premises. Off -sale of malt -liquor shall be limited to the hours of off sale liquor as set <br />forth in this Chapter and the malt liquor sold off -sale must be removed from the premises before <br />the off -sale closing; time. Malt liquor sold at off -sale under this license must be packaged in the <br />required packaging. <br />(8) On -Sale Brewpub. A brewpub may be issued an on -sale intoxicating liquor license or a 3.2 <br />percent malt liquor license for a restaurant operated in the place of manufacture. <br />(9) Off -Sale Small Brewer. A small brewer may, with the approval of the Commissioner of <br />Public Safety, be issued a license by the City for off -sale_ of malt liquor at its licensed premises <br />that has been produced and packaged by the brewer. The license must be approved by the <br />Commissioner. The amount of malt liquor sold at off -sale may not exceed 500 barrels annually. <br />Off -sale of malt liquor shall be limited to the hours of off -sale liquor as set forth in this Chanter <br />and the malt liquor sold off -sale must be removed from the premises before the off -sale closing <br />time. Malt liquor sold at off sale under this license must be packaged in the required packaging,. <br />Section 5. New Brighton City Code Section 4-106 is amended by deleting the stfie-ken material <br />and adding the underlined material as follows: <br />Sec. 4-106. Categories. <br />There shall be si* eicht categories of "on -sale" liquor licenses authorized to be issued by the <br />City. <br />
