February 24, 2015 Page 5 of 7 <br />explained that once the Preliminary Plat was approved the City was obligated to approve the Final Plat with <br />the eight conditions. She feared that if the home was not removed as recommended, it would remain in place <br />and the City would have no course of action. She explained that the City Attorney has advised against the <br />applicant's request and recommended the Council require the structure to be removed as suggested within the <br />Preliminary Plat. <br />Councilmember Bauman requested further information on the occupant of the existing home. Mr. Eck <br />explained that the home was being rented on a Contract for Deed to a woman who would be moving to <br />White Bear Lake. The women has requested she be allowed to tend the gardens one last time this summer. <br />Mayor Jacobsen questioned the risk of approving the preliminary plat. Assistant Director of Community <br />Assets & Development/Planning Director Gundlach reported the preliminary plat would be good for 12 <br />months. She reported that the biggest risk would be that the Preliminary Plat would be approved, the home is <br />never removed and the City would have no course of action to take because the Final Plat could be recorded <br />with the County. She commented that there may be a way for staff to work with the City Attorney to create a <br />financial guarantee to insure that the home was demolished <br />City Manager Lotter strongly encouraged the Council to stick with the City's established processes and <br />adhere to the recommendation of staff and the City Attorney. <br />Councilmember Bauman recommended that the applicant speak to their financers and explain that the <br />Preliminary Plat was approved with conditions and the Final Plat would be approved so long as all conditions <br />were being met. Assistant Director of Community Assets & Development/Planning Director Gundlach <br />reported that the Final Plat process was quite expeditious and could be approved in two or three weeks. She <br />noted this was a common practice by all communities. <br />Councilmember Bauman supported approving the Preliminary Plat this evening, but not the Final Plat. <br />Councilmember Jacobsen agreed. <br />Motion by Councilmember Jacobsen, seconded by Councilmember Bauman to adopt a Resolution <br />approving the Preliminary Plat subject to eight conditions. <br />Councilmember Strub stated he supported the proposed plat and believed it was an exciting plan for the City. <br />He reiterated that the Council was moving this item forward while taking into advisement the <br />recommendation from the City Attorney. <br />5 Ayes, 0 Nays -Motion Carried <br />2. Consideration of Resolution Awarding the Sale of $1,695,000 General Obligation <br />Improvement Bonds, Series 2015A. <br />City Manager Lotter indicated Mark Ruff of Ehlers & Associates would be presenting this item to the <br />Council. <br />Mark Ruff Ehlers & Associates requested the Council consider the issuance of $1,695,000 in General <br />Obligation Improvement Bonds for three years of street reconstruction improvement projects. He explained <br />that the interest rates were one-third of a percent lower than were anticipated He was pleased to report that <br />the City has maintained its AA rating. He recommended that the Council adopt the draft resolution for the <br />GO Improvement Bonds. <br />Councilmember Bauman requested further information on how General Obligation bonds were used by the <br />City. Mr. Ruff further defined how New Brighton would be using its General Obligation bonds for street <br />improvement projects over the next three years. <br />Mayor Jacobsen thanked Mr. Ruff for his expertise and assistance with the City's bond issuance. <br />Motion by Councilmember Burg, seconded by Councilmember Jacobsen to adopt a Resolution <br />awarding the sale of $1,695,000 General Obligation Improvement Bonds, Series 2015A; fixing their <br />form and specifications; directing their execution and delivery; and providing for their payment. <br />2.
