February 24, 2015 Page 4 of 7 <br />Aesthetic Improvements. <br />Motion by Councihnember Burg, seconded by Councihnember Jacobsen to approve the Consent <br />Agenda as presented. <br />5 Ayes, 0 Nays - Motion Carried <br />Public Hearing <br />None. <br />Council Business <br />1. Consideration of a Resolution Regarding a Preliminary Plat for Wayne Eck <br />concerning property located at 1321 & 1333 12th AVENUE NW creating five <br />lots on two blocks to be known as ECKSON. <br />City Manager Lotter indicated Assistant Director of Community Assets & Development/Planning Director <br />Gundlach would be presenting this item to the Council. <br />Assistant Director of Community Assets & Development/Planning Director Gundlach stated the applicant <br />is requesting Preliminary Plat approval in order to create five lots on two blocks to be known <br />as ECKSON. The two existing lots, 1321 and 1333 12th AVE NW each contain one single <br />family home. The applicant intends to remove the home at 1333 12th AVE NW and retain the <br />home located at 1321 12th AVE NW. The applicant has shown on the preliminary plat drawing <br />that one new lot would be created on block 1 (non -lakeside) and 4 new lots created on block 2. <br />Lot 4 of block 2 will have the north property line extended 10 feet in an effort to create <br />additional side yard setback for the existing home at 1321 12th AVE NW. The remaining lots <br />will be sold, some within the family, for construction of new single family homes. The <br />proposed plat results in a net increase of three lots/homes. The preliminary plat drawing shows <br />12th AVE NW being extended north a distance of approximately 330' with the construction of <br />a cul-de-sac. The boundary and topographic survey submitted by the applicant shows several <br />encroachments along the west property line including a driveway, shed and fence. The <br />applicant will need to work with the adjacent property owner at 1218 13th ST NW to ensure all <br />encroachments are eliminated in conjunction with the final plat application. A full plat analysis <br />is provided in the attached Planning Report dated 2/12/2015. Staff finds all criteria have been <br />met, subject to the conditions recommended by staff, along with requiring an updated survey of <br />the property. <br />Councilmember Jacobsen questioned if the cul-de-sac was the proper size. Assistant Director of Community <br />Assets & Development/Planning Director Gundlach indicated the proposed cul-de-sac was smaller in size. <br />This was reviewed by the Public Safety Department and there were no concerns with the turning radius. <br />Councilmember Bauman believed that the proposed plat would enhance the area. She suggested that a time <br />limit be set regarding the encroachment situation. She did not want to see the housing construction interfered <br />with because of the encroachment. Assistant Director of Community Assets & Development/Planning <br />Director Gundlach reported that the Preliminary Plat would be good for 12 months and if additional time was <br />needed to resolve the encroachment situation, the applicant could request an extension. Adam Eck, <br />representative for the applicant, noted the older home owner at 133312'h Avenue would be living at this <br />address through December of 2015. He requested the Council allow this structure to remain in place while <br />also allowing for the release of the Final Plat. Marty Kamp, Project Engineer for the Eck's, noted that <br />discussions have been entered into with the adjacent property owner. It appears that there is an easement for <br />the existing driveway. <br />Councilmember Strub requested further infornnation on the Preliminary and Final Platting process. Assistant <br />Director of Community Assets & Development/Planning Director Gundlach provided comment on the <br />platting process noting this was the first time she had heard the existing home was still occupied She <br />Public Hearing <br />Council Business <br />1.
