As of the drafting of this <br />memo, one public inquiry has been received and there are no known objections to this request. <br />Staff recommends approval of the request contingent on the applicant legally combining the <br />newly subdivided parcel with 50 32nd AVE NW. <br />Councilmember Burg asked how the lot combination would be completed. Assistant Director of Community <br />Assets and Development/Planning Director Gundlach explained the applicant will have to create some sort of <br />title to purchase it from the property owner to the south. Once the applicant has title, it would be recorded at <br />Ramsey County and the two parcels would have to be combined for tax purposes. <br />Mayor Johnson questioned why the applicant was requesting the minor subdivision. Bruce Knight, 50 32" d <br />Avenue NW, indicated the two encroachments would allow his neighbor to sell his home as buyers were <br />currently shying away from the home. In addition, he had an interest in leaving his retaining wall as is. <br />Mayor Johnson asked if the existing fence would remain in place. Mr. Knight commented the fence would <br />remain in place and he did not object to this encroachment. Assistant Director of Community Assets and <br />Development/Planning Director Gundlach provided further comment on the encroachments between the two <br />properties. <br />Councilmember Bauman supported the proposed agreement between the two property owners. <br />Councilmember Jacobsen questioned the size of the fence encroachment. Mr. Knight estimated the <br />encroachment was only six inches. He anticipated that in the future, the fence would be replaced and the <br />encroachment would be eliminated. <br />Mayor Johnson asked for additional comments from the public, there were none. <br />Motion by Councilmember Jacobsen, seconded by Councilmember Burg to close the <br />Public Hearing. <br />4 Ayes, 0 Nays - Motion Carried <br />The Public Hearing was closed at 7:21 p.m. <br />Motion by Councilmember Jacobsen, seconded by Councilmember Bauman to Adopt a Resolution <br />approving the subdivision, subject to the condition the applicant legally combine the <br />newly subdivided parcel with 50 32nd AVE NW. <br />4 Ayes, 0 Nays -Motion Carried <br />2.
