April 26, 2016 Page 11 of 13 <br />his opinion that Councilmember Bauman's actions were a breach or protocol and for that reason he would <br />support the censure. <br />Mayor Johnson explained there was a policy for the Council to follow in order to have questions answered <br />She feared that Councilmember Bauman's actions were a blatant attempt to overturn a Council decision <br />without fust having discussion at a Council level. <br />Councilmember Bauman clarified she used the word "appalled" and not the Cable Commission members. <br />She explained the Cable Commissioners were surprised and encouraged her to challenge the actions of the <br />City Council. She reiterated that in the past a Councilmember had contacted the City Attorney. She did not <br />believe her 20 -minute clarifying conversation had cost the taxpayers a great deal of money. She explained the <br />City Attorney advised her as to the language she should use on her petition. She believed it was so wrong that <br />the Mayor asked him to step down from his position for assisting her with her petition. <br />Mayor Johnson stated this comment was out of order. <br />City Manager Lotter offered for the Council's benefit that City Attorney Gilchrist understands the position he <br />put the Council in and he feels remorse for this situation. It was noted that City Attorney Gilchrist volunteered <br />to step down from his position. He noted the City would be appointing a new City Attorney that had a lighter <br />caseload and would be available to meet the City's needs. <br />City Clerk Haarstad commented there were some misconceptions on how the City could change a mayoral <br />term from two to four years versus changing the election year itself. She explained also that the City Attorney <br />is not statutorily tasked with deciding the question on a petition. She reported any resident can submit a <br />petition and once it is submitted the wording was then used in conjunction with the Ordinance to create the <br />ballot wording to be legally viable. She provided further comment on the June 1 't deadline. <br />Councilmember Bauman requested clarification on what being censured meant <br />Mayor Johnson explained Councilmember Bauman was being publically reprimanded for her actions. <br />City Manager Lotter asked if the Council was directing staff to draft a Resolution regarding the censure. <br />Mayor Johnson reported this was the case. <br />4 Ayes,1 Nay (Bauman)-Modon Carried <br />6. Consider Removing Councilmember Bauman from her various Council Liaison <br />Duties. <br />Motion by Mayor Johnson, seconded by Councilmember Burg to remove Councilmember Bauman <br />from her various Council Liaison Duties. <br />Mayor Johnson requested the Council remove Councilmember Bauman from acting as a liaison on behalf of <br />the City on her various commissions and committees. It was noted this would include the EDC, Cable <br />Commission and any other agencies she served on as an alternative. <br />Councilmember Jacobsen questioned why Mayor Johnson wanted to move forward with this Resolution. <br />Mayor Johnson believed the censorship needed to come with consequences. It was her opinion the mast <br />factor with Councilmember Bauman had been broken and it would take time for this trust to be regained She <br />did not see Councilmember Bauman following ethical procedures on behalf of the City and for this reason, <br />should not be acting as a City liaison. <br />Councilmember Bauman stated there was no proof of this, nor has any commission had any complaints about <br />her behavior. She indicated she was voted in as the President of the Cable Commission. She explained this <br />was a very important position to her. She believed the Mayor did not know her and should not be making <br />these claims. She felt she served the community well and was a detail oriented individual. She thought the <br />motion on the floor was wrong and believed local elected officials would question the motives of the City <br />Council. <br />Mayor Johnson reiterated the City Council recently voted to censure Councilmember Bauman. She <br />explained the Council was a unified body and was to act as a unified body. <br />3 Ayes, 2 Nays (Bauman and Jacobsen) -Motion Carried <br />6.
