July 12, 2016 Page 5 of 7 <br />Assistant Community Assets and Development/Planning Director Gundlach reviewed maps that depict <br />the alleyway vacation to be approved. Beyond the Resolution and maps, a Notice of <br />Completion of Vacation Proceedings is attached. The City Attorney’s office will submit this <br />for recording at Ramsey County, ensuring the vacation is properly applied to benefiting <br />property owners. It should be noted, the applicants contend this same alleyway was vacated <br />years ago. Staff cannot find any record of such vacation nor was it applied at the Ramsey <br />County’s Recorder Office. Even if it is later determined that this alleyway had been previously <br />vacated, there is no harm in the City Council adopting a new vacation resolution. Staff <br />recommended the Council hold a public hearing and approve the easement vacation. <br />Mayor Johnson suggested <br /> <br />Motion by Councilmember Burg, seconded by Councilmember Jacobsen to open the <br />Public Hearing. <br /> <br />4 Ayes, 0 Nays - Motion Carried <br /> <br />The Public Hearing was opened at 7:22 p.m. <br /> <br />Mayor Johnson asked for additional comments. <br />Joanie Babinski, 2581 17th Avenue NW, reviewed the history of the homes on this block noting <br />they were many were built by family members, uncle and grandparents. She understood the <br />alleyway had never been improved on this block and she was not in favor of an alleyway ever <br />being constructed. <br />Rostani Mr Felor, 2531 17th Avenue NW, was in agreement with Ms. Babinski. <br />Bruce Anderson, 2537 17th Avenue NW, supported Ms. Babinski’s opinion and requested that <br />only an easement remain within the alley right-of-way for the two utility companies. <br />Assistant Community Assets and Development/Planning Director Gundlach explained that the utility <br />easement would not be limited to the two utility providers currently within the alleyway. <br />Mayor Johnson thanked Ms. Babinski for sharing her stor y and understood the Babinski family <br />had a long history in New Brighton. <br /> <br />Motion by Councilmember Burg, seconded by Councilmember Jacobsen to close the <br />Public Hearing. <br /> <br />4 Ayes, 0 Nays - Motion Carried <br /> <br />The Public Hearing was closed at 7:28 p.m. <br /> <br />Councilmember Jacobsen asked if the proposed vacation would have any negative impact on <br />the adjacent residents.
