The purpose of Minnesota Statues, Section 462.3593 is to provide transitional housing for <br />seniors who can’t afford (or choose not) to recover in traditional transitional housing, such as a <br />nursing home. The law defines eligible persons as anyone who needs assistance with two or <br />more “instrumental activity of daily life” for mental or physical reasons. <br /> <br />Subdivision 9 allows cities to opt-out of the law if it is determined the expedited land use permit <br />is not well suited to the community. Based on discussions with Council and the Planning <br />Commission, it is being recommended New Brighton opt-out. However, the Planning <br />Commission will discuss development of a local legislative tool to allow similar dwellings for <br />future consideration by Council.
