August 8, 2016 Page 1 of 4 <br /> <br /> <br /> <br /> <br /> <br /> <br />Pursuant to notice thereof, a regular meeting of the New Brighton City Council was held Tuesday <br />August 8, 2016 at 6:30 pm in the New Brighton Council Chambers. <br /> <br />Present: Mayor Johnson, Councilmembers Burg, Jacobsen and Strub <br />Absent: Councilmember Bauman <br /> <br />Also Present: Dean Lotter-City Manager, Sarah Sonsalla-City Attorney <br /> <br /> <br />Call to Order <br />Mayor Johnson called the meeting to order at 6:30 pm. <br /> <br />Pledge of Allegiance <br />Mayor Johnson led the Council in the Pledge of Allegiance. <br /> <br />Public Comment Forum <br />Mayor Johnson opened the Public Forum for comments from the public. <br /> <br />Susan Erickson, 2012 29th Avenue NW, discussed a petition and lawsuit that was being put <br />together regarding Ordinance 829 against the City of New Brighton. She noted her attorney <br />had contacted the City Attorney and explained a suit would be brought due to the fact the City <br />illegally adopted Ordinance 829, and illegally rejected her previously submitted petition. She <br />stated the City Attorney informed her attorney that the City Council would not be meeting for <br />weeks and discussed the timeliness of this matter. She understood the City would begin <br />printing ballots soon in violation of the law. She requested the Council address Ordinance 829, <br />noting this Ordinance was to have been adopted no later than June 1st. She noted the ballot <br />question petition was submitted in a timely manner and was valid. She reported Minnesota <br />Court of Appeals has previously ruled on identical facts that the City Clerkâs treatment of the <br />petition was illegal. As a result, the petitioners have been forced to bring suit given the fact the <br />City was not following the law. A settlement has been brought to the City Attorney with a <br />deadline of today.
