to hear Councilmember Bauman state her case. He reviewed the City’s police regarding the use of City <br />resources. He explained that Councilmember Bauman went to the City Attorney after this body had given a 4- <br />1 vote on the odd/even elections. He stated that Councilmember Bauman’s intention was to draft a petition to <br />overturn the action of the City Council. <br /> <br />Councilmember Bauman reported the Council did not approve the Ordinance provided by the City Attorney <br />but rather approved their own Ordinance with extended terms. She believed the Council did prior to May 10th <br />was wrong and the State Statute was interpreted unfairly. It was her opinion the previous election was negated. <br /> <br />Mayor Johnson commented that Councilmember Bauman chose to go to the City Attorney regarding this <br />matter and kept this information to herself. <br /> <br />Councilmember Strub stated he had many of these same curiosities and stated if this had been brought to the <br />body it could have been brought to a vote, which would have allowed Councilmember Bauman the opportunity <br />to bring this matter to the City Attorney while avoiding all of the mess. However, Councilmember Bauman <br />chose to go another route and did not follow City protocol. He reiterated the fact that if any other New <br />Brighton resident had contacted the City Attorney with a question regarding a petition, the City Attorney <br />would not have taken the call. <br /> <br />Councilmember Burg wished the petition would have been approved originally. She did not want the City to <br />have a problem in the community and would have loved to have this on the ballot. She stated she had no <br />problem with the petition. She explained the problem was how Councilmember Bauman went about <br />contacting the City Attorney for assistance with the petition. <br /> <br />Councilmember Bauman commented she had submitted a legal petition, however, there was an interpretation <br />issue. She couldn’t understand why Councilmember Strub kept referring to a book. <br /> <br />Mayor Johnson requested the Council stay focused on the issue at hand. <br /> <br />Councilmember Strub explained he was referring to the Council Code of Conduct. <br /> <br />Councilmember Burg was in favor of the Council moving forward. She understood that this issue was not a <br />positive one for the City and she wanted to see the Council move past this. She explained she lost trust in <br />Councilmember Bauman because of her actions and the comments she made to one of her committees. <br /> <br />Mayor Johnson turned the focus back to the issue at hand again. She asked why Councilmember Bauman <br />should be reinstated. <br /> <br />Councilmember Bauman believed she was a valuable contributor on her committees and the action against her <br />should never have been taken. <br /> <br />Mayor Johnson commented that she has been asked by representatives from both committees (Cable <br />Commission and the EDC) to not have Councilmember Bauman reappointed. <br /> <br />Councilmember Jacobsen wanted to see the Council to move forward. <br /> <br />Councilmember Strub described the actions taken by Councilmember Bauman again stating she went around <br />City policy and for that reason he did not support her reappointment. <br /> <br />Councilmember Burg did not fault Councilmember Bauman for pursuing the petition. In fact, she expected it.
