November 22, 2016 Page 3 of 8 <br /> <br />Motion by Councilmember Strub, seconded by Councilmember Burg to approve the Consent <br />Agenda as presented. <br /> <br />Councilmember Burg thanked the Lions Club for their generous donation to the Public Safety Department. <br /> <br />5 Ayes, 0 Nays - Motion Carried <br /> <br />Public Hearing <br /> <br />1. Consideration of a Lawful Gambling Ordinance <br /> <br />City Manager Lotter explained Council directed the City Attorney to create an ordinance that was <br />discussed and revised by the City Council through work session discussions. He indicated the <br />City Council had repealed any type of regulation of charitable gambling in 2010. Interest has <br />been expressed by the current Council to further regulate this matter. <br />City Attorney Sonsalla reviewed the draft lawful charitable gambling ordinance with the <br />Council. She advised the following points are highlights of the Council’s direction to staff <br />regarding desired language to be included in the proposed Ordinance: <br /> <br /> Removed Hilltop from the trade area as it is not contiguous to the City of New <br />Brighton. <br /> Excepted out from City regulation all types of gambling that is excluded from state <br />licensing (Section 5‐ 75) <br /> Added an amount of $100 to the local permit fee. This is the maximum that the City <br />can charge. It cannot charge a fee for off‐site permits. <br /> Added a percentage range of 5‐40 percent of lawful purpose expenditures that must be <br />spent by an organization in the City’s trade area (Section 5‐80). <br /> Added a provision that would exempt current licensees/permit holders from the trade <br />area requirements (Section 5‐80). However, if the organization’s license/permit lapses, <br />is terminated, suspended or revoked, then it must comply with these requirements. <br /> <br />Lotter reported the Council also directed staff to notify affected businesses and tenants to be of <br />a scheduled public hearing for November 22, 2016. It was noted no hearing was required by <br />law, but Council felt it necessary to hold one in an effort to take public comment. <br /> <br />Motion by Councilmember Bauman, seconded by Councilmember Jacobsen to open the <br />Public Hearing. <br /> <br />5 Ayes, 0 Nays - Motion Carried <br /> <br />The Public Hearing was opened at 7:13 p.m. <br /> <br />Tracy Henry, 5211 Sunnyside Road in Mounds View, stated he worked with the Lake Region <br />Hockey Association and had approached the City for a charitable gambling license. He <br />explained that Cowboy Jack’s was doing really well for his organization. He discussed the <br />proposed Ordinance and asked how the City would be defining “trade area” and questioned if <br />neighboring communities had the same trade area requirement. He explained that Lake Region <br />Hockey Association spent the majority of their dollars on ice time for rinks that were outside of <br />the trade area. He understood his organization would be grandfathered in, but wanted further <br />clarification. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Public Hearing <br />1.
