CITY STAFF RESPONSES TO DNR COMMENTS ON DRAFT SHORELAND <br />ORDINANCE (AS OF 4/11/2016) <br />higher than 50%. <br /> Our existing standard for all of New Brighton residential <br />property is 50%. Currently, the community is <br />supportive of adopting a shoreland ordinance. If this <br />standard becomes too restrictive, the public will no <br />longer support this ordinance and it is likely the Council <br />would follow suit. <br />DP15 We added a bluff setback to Section 12-450(3). For <br />informational purposes, we did a bluff analysis for all of New <br />Brighton and we found 3 bluffs, 2 of which are very minor and <br />already developed. The third abuts an industrial use that already <br />meets the 30’ setback from top of bluff (north end of Rush <br />Lake). <br />JS16 No water oriented structures are allowed. We don’t even use or <br />define that term in our proposed ordinance so there isn’t a need <br />to prohibit something that doesn’t exist. Section 12-450(2) lists <br />the setbacks standards for principal AND accessory structures. <br />JS17 There is currently industrial-zoned property within the <br />shoreland. It all is nearly fully developed. As such, we <br />included the state “standards for commercial, industrial, public <br />and semi public uses” in proposed Section 12-480. <br />JS18 Yes, the City allows commercial and residential PUD’s, <br />although rare. Planned developments are currently regulated in <br />Chapter 7 of our Zoning Code. To ensure the DNR is put on <br />notice of future planned developments, we added planned <br />developments to the DNR Notification Procedures standards in <br />proposed Section 12-320. <br />JS19 The City does not rezone property through the Planned <br />Development process. Rather, the Planned Development <br />approval acts as an overlay to the underlying zoning. <br />JS20 Comment was implemented. <br />DP21 Comment was implemented. <br />JS22 Comment was implemented. <br />JS23 Comment was implemented. <br />
