CITY STAFF RESPONSES TO CITY ATTORNEY COMMENTS ON DRAFT <br />SHORELAND ORDINANCE (AS OF 4/11/2016) <br />COMMENT RESPONSE <br />A1 It is understood the draft ordinance includes standards not <br />consistent with state statute and staff continues to work with the <br />DNR for acceptance of flexibility. <br />A2 Staff continues to seek formal comment and acceptance from <br />the DNR. Staff’s latest communication with the DNR consists <br />of an email dated 4-11-2016. <br />A3 Comment was implemented. <br />A4 Comment was implemented. Staff included definitions for <br />Intensive Vegetation Clearing, Public Waters, ant Top of Bluff. <br />The other terms were not necessary to define based on the draft <br />ordinance. <br />A5 Comment was implemented <br />A6 Comment was implemented. Lot width standard is consistent <br />with state statute. Staff proposed an increase to the minimum <br />lot area to 20,000 SF (from 10,000 SF) for riparian lots within <br />the Shoreland only. <br />A7 Staff is seeking flexibility from the DNR for a 30’ height <br />allowance rather than 25’. The DNR has not commented on <br />this, suggesting acceptance of 30’. <br />A8 Staff continues to request 50% hardcover. See staff response to <br />DNR comment JS14. <br />A9 Comment was implemented. Commercial standards have been <br />incorporated into the draft ordinance dated 4-11-2016 under <br />proposed Section 12-480. The biggest impact is on the north <br />side of Jones Lake. Double the structure setback isn’t required <br />if uses are “substantially screened from view from the water”. <br />Little open water exists on Jones Lake so staff believes this isn’t <br />problematic for those adjacent industrial users. <br />A10 DNR has signaled they will accept 50’ for Jones Lake. <br />A11 DNR has signaled they will accept 50’ for Poplar Lake. <br />A12 No new wells will be drilled in the City so this comment does <br />not apply. <br />A13 Comment has been implemented. <br />
