PLANNING REPORT <br /> <br />DATE: May 11, 2016 <br />CASE: RD2016-001 <br />SUBJECT: Planned Residential Development Amendment Confirming Allowance of <br />the Existing 76 units at 2700 Rice Creek Road <br />APPLICANT: Michael Gould on behalf of New Brighton Senior Assisted Living <br />(Brightondale) <br /> <br />REQUEST & BACKGROUND <br />The applicant is requesting approval of an amendment to the original Planned Residential <br />Development (PRD) approval, confirming allowance of the existing 76 units at the senior <br />assisted living development at 2700 Rice Creek Road (known as Brightondale). There are no <br />planned improvements to the facility associated with this request. <br /> <br />The original PRD approval dates back to 1979 where 56 condominium units were approved. <br />That project was never constructed and the PRD approval was amended in 1985 to allow <br />construction of 72 units of senior housing. In 1997, a PRD amendment request was made to <br />allow 20 additional units but that request was never acted on and the applicant withdrew the <br />application. Then, in 2000 and 2009, requests were made to construct kitchen and dining room <br />additions. Some of those improvements were made and some were not, but the scope of work <br />during the land use review process did not include additional units. <br /> <br />Beyond land use approvals, the applicant has submitted numerous building permit requests <br />throughout the years. Based on the applicant’s narrative, staff reviewed building permit records <br />and found existence of building permits in years that coincide with the renovations noted in the <br />narrative. Those renovations yielded one additional unit in years 1993, 1996, 2006, and 2009, <br />bringing the property to its current unit count of 76. After reviewing some of that permit data, <br />and discussion with the Building Official and Building Inspector, it seems the renovations were <br />interior only and therefore did not trigger a planning review or recognition that densities were <br />increasing affecting the original PRD approval. <br /> <br />The applicant is now in the process of refinancing the property and is being faced with a legal <br />requirement from HUD (U.S. Department of Housing and Urban Development) to have the City <br />formally approve the existing 76 units. Staff and the applicant had hoped to address this issue <br />through a letter dated October 16, 2015 (see attachment), however that was not accepted.
