Community Assets & <br /> Development Department <br /> <br /> MEMORANDUM <br /> <br /> <br />DATE: May 11, 2016 <br /> <br />TO: Planning Commission <br /> <br />FROM: Janice Gundlach, Asst. Director of Community Assets & <br />Development/Planning Director <br /> <br />SUBJECT: Agenda Item #6A, Shoreland Ordinance <br /> <br />City staff has contacted the Minnesota Department of Natural Resources (DNR) three <br />times over the last 30 days concerning review and comment on New Brighton’s most <br />recent Shoreland Ordinance draft. Staff received an email response on Tuesday, May <br />10th that feedback would be offered by next week. Staff is unsure if this feedback will be <br />submitted in time for the Planning Commission’s hearing continuation on Tuesday, May <br />17th. <br /> <br />Staff is recommending the Commission re-open the public hearing, being the table action <br />from last month noted continuation on May 17th. If any interested public is in attendance <br />and wants to provide testimony, it should be taken. <br /> <br />Staff has no new information to report and therefore has not provided any additional <br />written materials, beyond this memo. Interested public should be advised to visit the <br />City’s website, where the Planning Commission materials from the April 19th meeting are <br />posted for public consumption. <br /> <br />If the DNR provides comments in time for the hearing on Tuesday, staff will provide that <br />information to the Commission and public. <br /> <br />Staff’s communications to the DNR over the last 30 days have indicated the City is ready <br />to adopt the draft ordinance. Being several deviations from the state standards are <br />proposed, staff has asked the DNR to formally approve those deviations, allowing the <br />Planning Commission and City Council to move to adopt the ordinance. The ability to <br />move the ordinance to adoption in June depends on the DNR’s comments on the latest <br />draft ordinance. <br /> <br />Staff is recommending the Planning Commission table action to the June 21, 2016 <br />meeting, pending receipt of comments and feedback from the DNR. <br />
