RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF AN AMENDMENT TO <br />A PREVIOUSLY APPROVED PLANNED RESIDENTIAL DEVELOPMENT. <br /> <br />WHEREAS, an application has been made by Michael Gould on behalf of New Brighton Senior <br />Assisted Living, known as Brightondale, to confirm allowance of the existing 76 units <br />where only 72 units was originally approved in 1985, and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Planned Residential Development Amendment was received on <br />April 28, 2016. <br />2. A public hearing notice was published in the New Brighton Bulletin on May 4, 2016. <br />3. Public hearing notices were mailed to property owners within 600’ of the applicant’s <br />property on May 6, 2016. <br />4. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on May 17, 2016 were all interested parties were heard. <br />5. The Planning Commission recommended approval on May 17, 2016. <br /> <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the <br />Planned Residential Development Amendment (RD2016-001): <br />1. The property is zoned R-2, Two Family Residential. <br />2. The property is guided in the New Brighton Comprehensive Plan for MDR, Medium <br />Density Residential. <br />3. The property is legally described as follows: <br />Lot 22, Block 1, PARK PLACE, Ramsey County, Minnesota <br />4. The original Planned Residential Development approval was in 1979 (PRD 27) and <br />permitted 56 condominium units, which was then revised in 1985 to allow for 72 units of <br />senior assisted living housing (PRD 44). <br />5. Based on the applicant’s submitted narrative, provided as an attachment to the Planning <br />Report dated May 11, 2016, interior renovations occurred in 1993, 1996, 2006, and 2009, <br />each yielding one additional unit bringing the total unit count to 76. <br />6. Review of City building permit records confirm permits were obtained in 1993, 1996, <br />2006, and 2009, however no zoning review was conducted because the renovations were <br />interior only. <br />7. The applicant has requested the existing 76 units are affirmed to be in compliance with <br />the Planned Residential Development approval. <br />8. The Planning Commission has reviewed the request in accordance with the stated <br />principals of the Planned Residential Development standards in Section 7-070 (2) (A – <br />G). <br />9. The Planning Commission determined the existing 76 units are in compliance with the <br />stated principals of Section 7-070 (2) (A – G) based on the following: <br />a. The density on site is not out of character for the surrounding neighborhood.
