Gould <br />3601 Park Center Boulevard, Suite 210 <br />St. Louis Park, MN 55416 <br /> <br />RE: Brightondale Assisted Living, 2700 Rice Creek Road, New Brighton, MN 55112 <br /> <br />Dear Mr. Gould: <br /> <br />At your request, I’ve been asked to provide verification on the number of units permitted at <br />Brightondale Assisted Living, 2700 Rice Creek Road. The nature of this inquiry is because <br />of conflicting zoning verification letters that have been drafted in years 2015, 2013, and <br />2009, which have formally stated the property is in compliance with current zoning <br />regulations with 72-76 units. <br /> <br />As has been previously communicated, Brightondale Assisted Living was approved via a <br />Planned Residential Development (PRD 44) in 1985. This approval is documented in City <br />Resolution 85-131A, adopted on November 26, 1985 and approved 72 units of senior <br />housing at 2700 Rice Creek Road. <br /> <br />Since the original approval, no other City approvals are on record permitting more than 72 <br />units, even though it is understood 76 units exists today. It is acknowledged that City records <br />indicate several building permits have been issued over the years, which likely resulted in the <br />unit count increase. Issuance of those building permits does not take the place of securing <br />zoning approval to increase the unit count from 72 units to 76 units. Because these building <br />permits consisted only of interior renovations, and no expansion of the building’s footprint or <br />height has been done since original construction, it is understood the 4 additional units were <br />absorbed within existing square footage. <br /> <br />Additionally, a Planned Residential Development Amendment approval was issued in 2009 <br />(a project that was not realized) where the written Planning and City Council reports <br />acknowledged the presence of 75 units of senior housing at Brightondale. This unit number <br />was acknowledged on the public record and during the course of the required public hearing. <br /> <br />Based on the information contained in this letter, 76 units exist today and the City has no <br />intention of taking enforcement action against Brightondale or Silvercrest for noncompliance <br />with the 1985 PRD approval.
