East: Long Lake Regional Park/Rice Creek <br /> West: Low Density Residential <br /> <br />SPECIAL USE PERMIT ANALYSIS <br />All Special Use Permits must be reviewed against Zoning Code Section 8-130. Staff has prepared <br />responses to the conditions noted in this section, which states that no special use shall be recommended <br />by the Planning Commission unless such shall find: <br /> <br />a. That the establishment, maintenance, or operations of the special use will not be detrimental <br />to or endanger the public health, safety, morals, comfort of the general public. <br /> <br /> Staff finds the proposed press box will not be detrimental to the general public. It will <br />replace the existing press box and will not further encroach into the required 30’ setback. <br /> <br />b. That the special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and impair <br />property values within the neighborhood. <br /> <br /> Staff finds the proposed press box will not be injurious to the use or enjoyment of <br />surrounding property. The press box will replace the existing press box, which according to <br />the applicant is showing signs of age and deterioration. <br /> <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the district. <br /> <br /> Staff finds this condition is met as the proposed press box will not have any impact on <br />surrounding development. While the size is increasing slightly, the overall impact is <br />negligible considering it’s only in use during sporting events that bring hundreds of <br />spectators to the site. <br /> <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br /> <br /> Staff finds that this condition is met as utilities and roads/access already exist and the press <br />box will use existing utilities. <br /> <br />e. That the special use shall, in all other respects, conform to the applicable regulations of the <br />district in which it located. <br /> <br />Staff finds this criterion to be met. Other than the 30’ setback to the southerly property line, <br />the press box is an accessory structure to the bleachers, only in use during sporting events, <br />and will not further impact the property beyond the impact of the current press box. A full <br />site plan analysis was not necessary. <br /> <br />Based on the conditions of Zoning Code Sections 4-030 (1) and 8-130, staff finds all Special Use criteria <br />to be met.
