<br /> <br />2 <br /> <br />days have indicated the City is ready to adopt the draft ordinance. Being several deviations from the state <br />standards are proposed, staff has asked the DNR to formally approve those deviations, allowing the Planning <br />Commission and City Council to move to adopt the ordinance. The ability to move the ordinance to adoption in <br />June depends on the DNR’s comments on the latest draft ordinance. Staff is recommending the Planning <br />Commission table action to the June 21, 2016 meeting, pending receipt of comments and feedback from the <br />DNR. <br /> <br />Commissioner Danger questioned the options for the Council if the DNR does not approve of the Shoreland <br />Ordinance. Planning Director Gundlach explained staff was working to negotiate with the DNR in order to <br />incorporate their changes. She indicated staff was waiting to hear from them with further feedback. <br />Commissioner Deick asked what the consequences were of not having a Shoreland Ordinance in place. <br />Planning Director Gundlach reported the City was working to put a Shoreland Ordinance in place and has <br />sought the DNR’s assistance. She stated it was unfortunate the DNR did not have the time to review and <br />provide feedback to the City in order for this matter to be finalized. <br /> <br /> <br />Motion by Commissioner McPherson, seconded by Commissioner Danger, to close the Public Hearing. <br /> <br />Approved 6-0. <br /> <br /> <br />Motion by Commissioner McPherson, seconded by Commissioner Murphy, to table action on the <br />Shoreland Ordinance to the June 21, 2016 Planning Commission meeting. <br /> <br />Approved 6-0. <br /> <br /> <br />Public Hearing – New Business: <br />(A) Mike Gould on behalf of New Brighton Senior Assisted Living requests a Planned Residential <br />Development amendment to allow 76 units at 2700 Rice Creek Road. <br /> <br />Planning Director Janice Gundlach reported the applicant is requesting approval of an amendment to the <br />original Planned Residential Development (PRD) approval, confirming allowance of the existing 76 units at the <br />senior assisted living development at 2700 Rice Creek Road (known as Brightondale). There are no planned <br />improvements to the facility associated with this request. The original PRD approval dates back to 1979 where <br />56 condominium units were approved. That project was never constructed and the PRD approval was amended <br />in 1985 to allow construction of 72 units of senior housing. In 1997, a PRD amendment request was made to <br />allow 20 additional units but that request was never acted on and the applicant withdrew the application. Then, <br />in 2000 and 2009, requests were made to construct kitchen and dining room additions. Some of those <br />improvements were made and some were not, but the scope of work during the land use review process did not <br />include additional units. <br /> <br />Planning Director Gundlach stated beyond land use approvals, the applicant has submitted numerous building <br />permit requests throughout the years. Based on the applicant’s narrative, staff reviewed building permit records <br />and found existence of building permits in years that coincide with the renovations noted in the narrative. Those <br />renovations yielded one additional unit in years 1993, 1996, 2006, and 2009, bringing the property to its current <br />unit count of 76.
