<br /> <br />3 <br /> <br />Building Inspector, it seems the renovations were interior only and therefore did not trigger a planning review <br />or recognition that densities were increasing affecting the original PRD approval. <br /> <br />Planning Director Gundlach explained the applicant is now in the process of refinancing the property and is <br />being faced with a legal requirement from HUD (U.S. Department of Housing and Urban Development) to have <br />the City formally approve the existing 76 units. Staff and the applicant had hoped to address this issue through a <br />letter dated October 16, 2015, however that was not accepted. The only official course of action left is to <br />consider an amendment to the original PRD. Staff recommends approval of the request as submitted. <br /> <br />Chairperson Nichols-Matkaiti encouraged staff to review building permits more closely in the future in the case <br />another building opts to increase its density through a building renovation. <br />Mike Gould, 2700 Rice Creek Road, thanked the Commission for their consideration. He provided further <br />comment on the renovations he has made to his property over time. <br /> <br /> <br />Motion by Commissioner Danger, seconded by Commissioner Murphy to close the Public Hearing. <br /> <br />Approved 6-0. <br /> <br /> <br />Motion by Commissioner McPherson, seconded by Commissioner Frischman, to approve staff <br />recommendation. <br /> <br />Approved 6-0. <br /> <br />(B) Larson Engineering on behalf of ISD 621 requests a Special Use Permit and Nonconforming Use <br />Permit to allow replacement of the existing 8’ x 42’ pre-fabricated press box at the stadium with <br />a new 9’ x 54’ pre-fabricated press box at Irondale High School, 2425 Long Lake Road. <br /> <br />Planning Director Janice Gundlach reported the applicant has requested a Special Use Permit to allow for the <br />construction of a 9’ x 54’ stadium press box at Irondale High School. The high school is a specially permitted <br />use in a residential district, which requires review and approval of a Special Use Permit anytime an <br />improvement is proposed impacting the site. The proposed press box will replace the existing 8’ x 42’ press box <br />located on the south bleachers of the football field. The press box is a pre-fabricated structure and anchored <br />within the bleachers structure. <br /> <br />Planning Director Gundlach explained the applicant is also requesting a Nonconforming Use Permit because a <br />30’ setback is required from an R-1 or R-2 zoned property. The applicant has submitted plans showing the <br />location of the existing and proposed press box to be 11.4 feet from the southern property line. Per Zoning Code <br />Section 4-030 (1) schools are permitted by Special Use Permit provided “no structure shall be nearer than thirty <br />feet to any R-1 or R-2 lot line”. The zoning of the abutting property to the south is R-2. Staff recommends <br />approval of the Special Use Permit and Nonconforming Use Permit subject to the following condition: <br /> <br />1. The proposed press box is constructed in accordance with the plans submitted with the Special Use <br />Permit and Nonconforming Use Permit applications. <br />
