CANIBUILDANYTHINGWITHINTHE
SHORELAND?
Most properƟes within the deĮned shoreland (1,000 feet from lake, 300 feet from Rice Creek) will have NO addi-
Ɵonal regulaƟons imposed on their property by this proposed ordinance.

However, property owners who live directly on a DNR designated lake or Rice Creek must meet the following
building setbacks:

RequiredSetback
Jones Lake 50 feet
Long Lake 50 feet
Pike Lake 50 feet
Poplar Lake 50 feet
Rush Lake 150 feet*
Rice Creek 50 feet*

*Please note there was a typo on the 9/17/2015 invitaƟon to the open house. The leƩer indicates a 75 foot set-
back from Rush Lake and a 25 foot setback from Rice Creek. This was INCORRECT and the correct setbacks are
noted in the above chart.

There are excepƟons to these setbacks, including:

x If your neighbor’s home is closer than the setbacks noted above, the average setback will be used instead of
the setbacks noted above (see board illustraƟng an average setback). This only applies when the average set-
back is closer than the required setback, not farther.
x Stairways, liŌs, and landings that are necessary to gain access to the shore.
x Docks, watercraŌ liŌs, and landing faciliƟes.
x Fences**, retaining walls, and ancillary recreaƟonal uses such as swing sets or other sporƟng equipment.

**See separate board regarding fences (some restricƟons will apply).
WHATIFIALREADYHAVEASTRUCTURE/BUILDING
WITHINTHESESETBACKS?
ExisƟng structures/buildings will be allowed to persist as nonconformiƟes.
