1 <br />RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL A SPECIAL USE PERMIT <br />AND VARIANCE FOR ST. JOHN’S THE BAPTIST CEMETERY LOCATED AT THE NORTHWEST CORNER OF <br />7TH ST NW AND 11TH AVE NW. <br /> <br />WHEREAS, an application has been made by St. John’s the Baptist Cemetery to allow construction <br />of a Cremation Garden, including stone cabinets (Columbaria), benches, walkways, parking <br />stalls, sculpture, and landscaping at the existing cemetery property located at the northwest <br />corner of 7th ST NW and 11th AVE NW, and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. Applications for a Special Use Permit and Variance were received on August 31, 2016. <br />2. A public hearing notice concerning the request was published in the September 7, 2016 <br />edition of the New Brighton Bulletin. <br />3. Public hearing notices were mailed to property owners within 350’ of the property on <br />September 8, 2016. <br />4. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on September 20, 2016 and all present were given a chance to freely speak at the hearing. <br />5. The Planning Commission recommended conditional approval on September 20, 2016. <br /> <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the <br />Special Use Permit (SP2016-011) and Variance (VN2016-002): <br />1. The property is zoned R – 1, Single Family Residential. <br />2. The existing cemetery is considered a specially permitted use. <br />3. The property is guided in the Comprehensive Plan for P-QP, Public-Quasi Public. <br />4. The property is legally described as follows: <br />Lots 4, 6, 10, 11, 12, & 15, Block 4, SOUTH PARK ADDITION TO MINNEAPOLIS <br />STOCK YARDS, Ramsey County, Minnesota. <br />And <br />The Entire Plat of ST. JOHN THE BAPTIST CEMETERY, Ramsey County, Minnesota. <br />5. The applicant is proposing to construct stone cabinets for above ground ash storage, <br />including associated walkways, benches, landscaping, signage, parking stalls and sculpture, <br />which require a Special Use Permit based on underlying residential zoning. <br />6. The applicant intends to phase the stone cabinets in as demand dictates, with the three mostly <br />easterly cabinets, parking stalls, central walkway, two benches, and landscaping in Phase 1. <br />7. Future walkways and landscaping will be installed surrounding future stone cabinets. <br />8. The Planning Commission considered the following special use permit criteria of Zoning <br />Code Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare.
