1 <br />RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL A SITE PLAN AND <br />NONCONFORMING USE PERMIT FOR 575 OLD HIGHWAY 8 NW. <br /> <br />WHEREAS, an application has been made by Cary Becker on behalf of Becker Building and <br />Remodeling to allow construction of a 1,400 SF addition to the existing building, including <br />removal of the southerly 30’ x 20.5’ square footage, and associated covered entry, parking and <br />landscaping improvements at 575 Old Highway 8 NW, and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. Applications for a Site Plan and Nonconforming Use Permit were received on August 31, <br />2016. <br />2. A public hearing notice concerning the requests was published in the September 7, 2016 <br />edition of the New Brighton Bulletin. <br />3. Public hearing notices were mailed to property owners within 350’ of the property on <br />September 9, 2016. <br />4. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on September 20, 2016 and all present were given a chance to freely speak at the hearing. <br />5. The Planning Commission recommended conditional approval on September 20, 2016. <br /> <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the Site <br />Plan (LP2016-006) and Special Use Permit (SP2016-06): <br />1. The property is zoned B – 3, General Business. <br />2. The property is guided in the Comprehensive Plan for CB, Community Business. <br />3. The property is legally described as follows: <br />Per Title Commitment No. 543352, Issued by Land Title <br />That part of the North 100.00 feet of the South 580.00 feet of the West 260.00 feet of the <br />Southwest Quarter of the Northeast Quarter (SW1/4, NE1/4) of Section 29, Township 30, <br />Range 23, Ramsey County, MN., lying easterly of the east line of State Trunk Highway No. <br />8. <br />4. The applicant is proposing to construct a 1,400 SF addition to the existing building, including <br />removal of the southerly 30’ x 20.5’ square footage, and associated covered entry, parking, <br />and landscaping improvements. <br />5. The Planning Commission considered the Site Plan in accordance with B - 3 district <br />standards of Section 5-250, the commercial performance standards of Section 6-390, Site <br />Plan and Nonconforming Use standards of Section 8-130 and 8-460 respectively, and the <br />parking standards of Chapter 11 of the Zoning Code. <br />6. The Planning Commission found all applicable Site Plan standards to be met based on the <br />analysis within the Planning Report dated 8/15/2016. <br />7. The Planning Commission determined the following nonconformities exist on the site: <br />a. 0’ parking lot setbacks to the north and south side yards per Section 11-020 (6). <br />b. Lack of appropriate materials on the street side of the structure per Section 6-390 (12).
