2 <br />c. Curb cuts not meeting maximum width and minimum separation requirements per <br />Section 11-020 (8) (J). <br />8. The Planning Commission considered the Nonconforming Use Permit in accordance with the <br />following criteria of Section 8-460 (2): <br />a. The total number of nonconformities is reduced. <br />b. The impact of any nonconformity upon adjacent premises is reduced to the greatest <br />practical extent. <br />c. The extent of any nonconformity is reduced where practical. <br />9. The Planning Commission found the nonconforming use permit criteria are met based on the <br />following: <br />a. The 5’ side yard parking lot setback nonconformities will be eliminated. <br />b. Implementation of new exterior materials that will comply with Section 6-390 (12) and <br />positively impact the aesthetics of the neighborhood and Old Highway 8 corridor. <br /> <br />NOW THEREFORE BE IT RESOLVED, that based upon the above Findings of Fact the application <br />for a Site Plan (LP2016-006) and Nonconforming Use Permit (NC2016-006) are hereby <br />recommended for approval, subject to the following conditions: <br />1. The project is developed in accordance with the submitted plans, provided as attachments <br />to the Planning Report dated 8-15-2016, except as otherwise noted in the conditions of <br />approval. <br />2. The applicant implements the recommendations noted in the Interoffice Engineering <br />Memo. <br />3.
