Staff finds this criterion to be met. The applicant is proposing three very small structures, <br />which merely allow use the property in a manner in which the property is already being <br />used. Columbaria are also common offerings for cemeteries. <br /> <br />(3) The circumstances requiring the variance apply to the property and are not of an economic <br />nature. <br /> <br />Staff finds this criterion to be met. Based on how the property has developed over the years, <br />this is the only remaining location where the proposed improvements can be placed. <br />Relocating the cabinets more interior to the site would require relocation of existing burial <br />plots and gravestones, which likely would be more intrusive to the neighborhood and public <br />than what the applicant has proposed. <br /> <br />(4) The variance does not negatively impact the character of the locality. <br /> <br />Staff finds this criterion to be met. The stone cabinets are not that much larger than some of <br />the gravestones on site, some of which are closer to the property line than the proposed 15.5’ <br />setback. Additionally, the applicant is proposing landscaping, mitigating some of the visual <br />aspects of the cabinets and garden. <br /> <br />(5) The variance is consistent with the Comprehensive Plan. <br /> <br />Staff finds this criterion to be met. The proposed use of the variance is consistent with the <br />existing use and the allowances under the Zoning Code and public-quasi-public guide plan <br />designation noted in the Comprehensive Plan. <br /> <br />Staff finds all Variance criteria have been met and would recommend approval. <br />
