A complete application for a Site Plan and Special Use Permit was received on April 28, <br />2016. <br />2. Notice of a public hearing was published in the May 4th edition of the New Brighton Bulletin. <br />3. Public hearing notices were mailed to property owners within 350’ of the property boundary <br />on May 6, 2016. <br />4. The Planning Commission considered the request and held a public hearing on May 17, <br />2016. <br />5. The Planning Commission recommended approval of the Site Plan and Special Use Permit <br />subject to conditions. <br />6. The City Council adopted Resolution 2016-057 on May 24, 2016, approving the Site Plan <br />and Special Use Permit. <br />7. The applicant submitted for an amended Site Plan the following month on June 10, 2016. <br />8. The Planning Commission considered the amended Site Plan on June 21, 2016. <br />9. The City Council considered the amended Site Plan and approved is on June 28, 2016 by <br />adopting Resolution 2016-064. <br />10. On October 26, 2016 the applicant made a request to amend the amended Site Plan. <br />11. The Planning Commission considered the request on November 15, 2016. <br /> <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the <br />Amended Site Plan (LP2016-007): 1. The proposed is located at 251 5th ST NW and legally described as follows: <br />That part of the Northeast Quarter of the Southeast Quarter (NE ¼ of SE ¼), Section 29, <br />Township 30 North, Range 23 West, Ramsey County Minnesota, described as follows to <br />wit: <br />Beginning at a point on the North line of the Southeast Quarter (SE¼) 682.11 feet West <br />of the Northeast corner; thence South 01 degree 01 minute East 1,313.60 feet to an iron <br />pin on the South line of the Northeast Quarter of the Southeast Quarter (SE¼ of SE¼); <br />thence North 89 degrees 03 minutes 30 seconds East 451.4 feet along said South line to <br />an iron pin on the West right of way line of T.H. 35W; thence Northerly 97.3 feet along <br />the West right of way line of T.H. 35W; thence 450 feet along the West right of way line <br />of T.H. 35W; thence Northerly 525 feet along the West right of way line of T.H. 35W to
