WHEREAS, an application has been made by Simply Self Storage for consideration of a Site Plan Amendment, eliminating the mezzanine level and increasing the footprint dimensions of the building, which is to be an interior climate controlled self-storage facility at 251 5th Street NW, and WHEREAS, the procedural history of the application is as follows: 1. A complete application for a Site Plan and Special Use Permit was received on April 28, 2016. 2. Notice of a public hearing was published in the May 4th edition of the New Brighton Bulletin. 3. Public hearing notices were mailed to property owners within 350’ of the property boundary on May 6, 2016. 4. The Planning Commission considered the request and held a public hearing on May 17, 2016. 5. The Planning Commission recommended approval of the Site Plan and Special Use Permit subject to conditions. 6. The City Council adopted Resolution 2016-057 on May 24, 2016, approving the Site Plan and Special Use Permit. 7. The applicant submitted for an amended Site Plan the following month on June 10, 2016. 8. The Planning Commission considered the amended Site Plan on June 21, 2016. 9. The City Council considered the amended Site Plan and approved is on June 28, 2016 by adopting Resolution 2016-064. 10. On October 26, 2016 the applicant made a request to amend the amended Site Plan. 11. The Planning Commission considered the request on November 15, 2016. WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the Amended Site Plan (LP2016-007): 1. The proposed is located at 251 5th ST NW and legally described as follows: That part of the Northeast Quarter of the Southeast Quarter (NE ¼ of SE ¼), Section 29, Township 30 North, Range 23 West, Ramsey County Minnesota, described as follows to wit: Beginning at a point on the North line of the Southeast Quarter (SE¼) 682.11 feet West of the Northeast corner; thence South 01 degree 01 minute East 1,313.60 feet to an iron pin on the South line of the Northeast Quarter of the Southeast Quarter (SE¼ of SE¼); thence North 89 degrees 03 minutes 30 seconds East 451.4 feet along said South line to an iron pin on the West right of way line of T.H. 35W; thence Northerly 97.3 feet along the West right of way line of T.H. 35W; thence 450 feet along the West right of way line of T.H. 35W; thence Northerly 525 feet along the West right of way line of T.H. 35W to
