PLANNING REPORT <br /> <br />DATE: November 10, 2016 <br />CASE: NC2016-007 <br />SUBJECT: Nonconforming Use Permit for 2166 Lakebrook Drive to Allow Existing <br />Nonconforming Front Yard and Shoreland Setbacks to Persist <br />APPLICANT: Tim Nelson on behalf of Irfan Sandozi <br /> <br />REQUEST & BACKGROUND <br />The applicant is requesting a Nonconforming Use Permit to allow for construction of garage and <br />living space additions to the existing home at 2166 Lakebrook Drive. Even though the proposed <br />additions meet minimum setback requirements, a Nonconforming Use Permit is required because <br />existing front yard and shoreland setbacks are less than required by code and the applicant <br />wishes to maintain these nonconformities in conjunction with this project. <br /> <br />This property is located on the peninsula area at the northeast corner of Long Lake. The lots in <br />this area are shallow so it isn’t uncommon for front yard and shoreland setbacks to be less than <br />required by code, especially since the Shoreland Ordinance was adopted in late July, 2016.
