<br /> <br />1 <br /> <br />PLANNING COMMISSION PROCEEDINGS <br /> <br />Regular Meeting – July 19, 2016 7:00 p.m. <br /> <br />Present: Chairperson Erin Nichols-Matkaiti, Commissioners Steve Danger, Marvin Deick, Jeanne Frischman, <br />Dania Miwa, Melissa Murphy, and Verne McPherson <br /> <br />Absent: None <br /> <br />Also Present: Janice Gundlach- Assistant Director of Community Assets & Development/Planning Director, <br />and Paul Jacobsen-Councilmember <br /> <br />Agenda Review: There were no changes to the agenda. <br /> <br />Minutes from June 21, 2016: <br /> <br />Motion by Commissioner Danger, seconded by Commissioner McPherson, to approve the June 21, 2016 <br />meeting minutes as presented. <br /> <br />Approved 7-0. <br /> <br />Council Action: Councilmember Jacobsen reported Public Safety Director Bob Jacobson and Fire Captain <br />Jerry Hedman were both retiring from the City of New Brighton and were recognized at the last Council <br />meeting. He discussed an easement vacation that was approved by the Council and provided a road <br />construction update. He indicated the water distribution interconnection was now in place with the City of <br />Minneapolis. He invited the public to attend a meet and greet meeting at Vermont Park on Thursday, July 21st <br />at 6:00 p.m. He reported the City was still seeking election judges for the Primary and General elections. <br />Those interested in serving were encouraged to contact City Hall for further information. <br /> <br />Public Hearing – Old Business: <br />(A) The City of New Brighton requests consideration of a new Chapter 12 to the New Brighton <br />Zoning Code, creating a Shoreland Ordinance. <br /> <br />Planning Director Janice Gundlach reported the City is initiating adoption of a Shoreland Ordinance as a new <br />Article 1, Chapter 12 to the New Brighton Zoning Code. This ordinance would create a Shoreland Overlay <br />District for any property that lies within 1,000’ of the Ordinary High Water Level (OHWL) of a Minnesota <br />Department of Natural Resources (DNR) regulated lake (Long Lake, Pike Lake, Rush Lake, Poplar Lake, and <br />Jones Lake) and within 300’ of Rice Creek. The purpose of a Shoreland Ordinance, as provided under <br />Minnesota Statutes 103F.201, is to provide guidance for the wise development of shoreland of public waters <br />and thus preserve and enhance the quality of surface waters, to preserve the economic and natural <br />environmental values of shorelands, and to provide for the wise use of water and related land resources of the <br />state. <br /> <br />Planning Director Gundlach stated the process of drafting and adopting a Shoreland Ordinance has taken much <br />longer than expected. This is because of the various areas of flexibility the City has sought from the state <br />standards, the time needed to obtain feedback from the DNR, the time needed for City Attorney review, and
