Police Use of Force Overview – Sgt. Emerson

Sgt. Emerson defined use of force and the criteria which are used to determine when force may
be used. He referenced Minnesota Criminal Code and NBDPS General Order 1. Four
circumstances when use of force is authorized include: 1. In effecting a lawful arrest; 2. In the
execution of legal process; 3. In enforcing an order of the court; and 4. In executing any other
duty imposed upon the public officer by law.

Sgt. Emerson reviewed the State statute on Use of Deadly Force and noted four deadly force
circumstances. Sgt. Emerson reviewed use of non-lethal weapons such as strangle holds or the
use of a baton/flashlight/gun as a club to strike a person’s head. He also reviewed the use of
ASR and Taser.

Sgt. Emerson explained circumstances which justify the use of deadly force and the liabilities
attached to the use of force. Sgt. Emerson reviewed the Use of Force Continuum which is part of
our General Orders.

Sgt. Emerson explained and demonstrated the use of verbalization and command presence skills
used in potential use of force incidents. Any deadly use of force incident would be investigated
by an outside agency; we would request the Bureau of Criminal Apprehension (BCA) to do the
investigation.

Updates
A.
