May 212017 Page 6 of 9 <br />City Manager Lotter indicated Assistant Director Community Assets and Development/Planning Director <br />Gundlach would be presenting this item to the Council. <br />Assistant Director Community Assets and Development/Planning Director Gundlach explained Dan <br />Mueller of Ryan Companies, acting on behalf of TUV SUD, America, Inc. (TUV) has <br />submitted the following land use applications in support of development of Block D in New <br />Brighton Exchange with a 37,000 SF office/testing/certification building and associated site <br />improvements, including surface parking, landscaping, and utilities: <br />Preliminary & Final Plat: Converts the existing legal description from an <br />undevelopable outlot to a lot and block definition. Will also amend the existing <br />physical property boundaries to meet the needs of the development. <br />Preliminary & Final Planned Unit Development: Allows development of the property <br />under NBE, New Brighton Exchange zoning district regulations, with specified <br />deviations in connection with enhanced pedestrian and landscaping features. <br />Site Plan: Provides an analysis of the proposed plans to ensure compliance with <br />minimum development standards in the Zoning Code. <br />Assistant Director Community Assets and Development/Planning Director Gundlach stated the proposed <br />building will be used for office, testing, and certification in support of TUV's business -to - <br />business engineering service that provides international safety testing and certification. TUV <br />has indicated the proposed building would employ 55 persons. Staff explained this property is <br />located on the east side of Old Highway 8 NW within the New Brighton Exchange <br />redevelopment area. The development will occur on property known as Block D, which <br />consists of approximately four acres of land. This property is directly adjacent to the Old <br />Miller Dump, where the City implemented a clean-up plan in 2008-2010, and is part of the <br />former Butcher's Spur rail line. While this property is not part of the dump and the railroad has <br />been removed, its proximity to both the dump and former rail line creates the need to secure <br />approvals from the Minnesota Pollution Control Agency with regard to old railroad debris and <br />soil gas (methane) migration sub -surface from the dump. <br />Assistant Director Community Assets and Development/Planning Director Gundlach indicated the Site <br />Plan includes a 12,200 SF expansion space with additional surface parking. This is included for <br />illustrative purposes only and would require a separate Site Plan and Planned Unit <br />Development approval prior to construction. The purpose of depicting this on the Site Plan is <br />to provide a broader perspective of how Block D will appear fully developed. <br />Assistant Director Community Assets and Development/Planning Director Gundlach commented the <br />Planning Commission discussed the Planning Report and agreed with the staff <br />recommendation that all Site Plan, Planned Unit Development, and Platting standards have <br />been met. Via the PUD, the applicant will be permitted various deviations from underlying <br />zoning district standards based upon the proposed pedestrian connection to Old Highway 8 <br />NW and the proposed enhanced Landscape Plan. The recommendation is based upon the seven <br />conditions outlined in the Resolution. <br />Councilmember Strub explained the Planning Commission discussed this request at their May I e meeting <br />and offered their full support <br />Councilmember Bauman requested further information on the plat. Assistant Director Community Assets <br />and Development/Planning Director Gundlach reported Ryan Companies submitted the plat to Ramsey <br />County two weeks ago and staffdid not anticipate there being any problems. <br />Councilmember Bauman indicated she was pleased to see TUV SUD staying in the community. <br />Dan Mueller, Ryan Companies, thanked the Council and staff for their support. He too was happy that TW <br />SUD would be able to remain in the community. <br />
