499366v1 DTA NE136-8 2 <br />3. COMPENSATION. <br /> <br />The City shall compensate the Inspector at a rate of $65.00 per hour for providing the <br />Authorized Services. The Inspector shall invoice the City on a monthly basis and each <br />invoice shall include an itemized report that summarizes the total hours worked during <br />the applicable invoice period. Invoices submitted will be processed and paid in the same <br />manner as other claims made to the City. <br /> <br />4. INDEPENDENT CONTRACTOR. <br /> <br />4.01. The Parties acknowledge and agree that the Inspector is an independent contractor <br />and not an employee of the City. The Inspector has no authority to make any binding <br />commitments or obligations on behalf of the City. The Inspector understands that the <br />City will not provide the Inspector with any benefits of any type in connection with <br />this Agreement, including but not limited to, health or medical insurance, workers’ <br />compensation insurance and unemployment, nor will the City withhold any state or <br />federal taxes, including income or payroll taxes and social security taxes, which may <br />be payable by the Inspector. <br /> <br />4.02. The Inspector shall supply, at its own expense, all equipment, supplies, vehicles <br />and tools necessary to complete all of its obligations under this Agreement. <br /> <br />4.03. The Inspector acknowledges that any instruction it receives from the City has no <br />effect on its status as an independent contractor. The Inspector acknowledges that <br />the daily administration of the Authorized Services rendered to the City shall be <br />under the sole direction of the City’s Building Official, the City’s Assistant <br />Director of Community Assets and Development/Planning Director, or his or her <br />designee. <br /> <br />5. LICENSE AND INSURANCE. <br /> <br />5.01. The Inspector shall maintain workers’ compensation insurance (to the extent <br />required by law) and commercial general liability insurance for both bodily injury <br />and property damage with a per occurrence limit of no less than $1,500,000 for <br />each. <br /> <br />5.02. The Inspector shall also maintain automobile liability insurance with a limit of not <br />less than $250,000 for each accident. This insurance shall cover liability arising <br />out of any auto, including owned, hired and non-owned autos. <br /> <br />5.03. The City shall be named as an additional insured under the Inspector’s insurance. <br />The certificate and the required insurance policies shall contain a provision that <br />the coverage afforded under the insurance contract will not be canceled or <br />allowed to expire until at least 30 days prior written notice has been given to the <br />City. At the City’s request, a certificate of insurance acceptable to the City shall <br />be provided by the Inspector to the City.
