2 <br />b. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />e. That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />9. The Planning Commission and City Council found all Special Use Permit criteria of Section <br />8-130 to be met due to the following: <br />a. The applicant has demonstrated through 5-6 years of operation that Pets Remembered <br />does not produce negative impacts to surrounding property. <br />b. The proposed location is in a primarily industrial area with no residential uses adjacent. <br />c. Adequate parking will be provided on site. <br />d. The cremation services will be for pets only, limited to one-at-a-time cremation of 200 <br />LBS or less. <br /> e. The site is used and surrounded by other industrial uses. <br />f. The applicant has provided technical information on the proposed cremation machine <br />which states that emissions are below MPCA guidelines and there are no odors emitted <br />into the air (only heat vapors). <br />g. The second cremation machine will be the same make as the cremation machine currently <br />in operation and researched as part of the original Special Use Permit approved in 2011. <br /> <br />NOW THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application <br />for a Site Plan (PSP17-0004) and Special Use Permit (PSCI17-0002) is hereby approved, <br />subject to the following conditions: <br />1. The applicant implements the Site Plan and Special Use per the plans submitted and <br />attached to the Planning Report dated November 21, 2017. <br />2. Prior to issuance of a building permit, the applicant submits plans signed by a licensed <br />architect to be reviewed by the Planning Director to ensure compliance with the <br />representations made in the conceptual drawings attached to the Planning Report. <br />3. The applicant continues to honor the business model of one-at-a-time cremation and <br />animals shall not exceed 200 lbs. <br />4. The 12’ front yard driveway encroachment is removed prior to a footing/foundation <br />inspection on the addition. <br />5. The second cremation machine shall qualify as a Class IV waste combustor per the <br />MPCA guidelines and be a B & L 200, identical to the machine currently in operation at <br />the business. It is the applicant’s responsibility to follow MPCA rules and guidance <br />regarding whether air permits are necessary. <br />6. Unclaimed ashes are managed in a lawful manner. <br />7. No odors shall be detectable at or beyond the property line per Zoning Code Section 6- <br />390 (8). <br />8. The necessary stack from the second cremation machine shall comply with MPCA rules <br />concerning ambient air pollution concentrations and the stack shall be located on the <br />south side of the pitched roof.
