1 <br />RESOLUTION NO. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN AND SPECIAL USE PERMIT <br />FOR 15 2ND AVE SE. <br /> <br />WHEREAS, an application has been made by Donald Wyland on behalf of Pets Remembered to <br />allow construction of a 10’ x 25’ addition to the existing building, and to allow installation of a <br />second cremation machine at 15 2nd AVE SE, and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on October 17, 2017. <br />2. A public hearing notice was published in the November 1st edition of the New Brighton <br />Bulletin. <br />3. Notices of a public hearing were mailed to property owners within 350’ of the property on <br />November 2, 2017. <br />4. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on November 21, 2017 and all present were given a chance to freely speak at the hearing. <br />5. The Planning Commission voted to recommend approval on November 21, 2017 subject to <br />conditions. <br />6. The City Council considered the request on November 28, 2017. <br /> <br />WHEREAS, the Planning Commission and City Council make the following Findings of Fact with <br />respect to the Site Plan (PSP17-0004) and Special Use Permit (PSCI17-0002): <br />1. The property is legally described as following: <br />Lot 30, Block 2, Vermont Park and adjacent vacated Clinton Street together with adjacent <br />vacated alley, Ramsey County, Minnesota <br />2. The property is zoned I-1, Light Industrial. <br />3. The property is guided in the Comprehensive Plan for Light Industrial. <br />4. The applicant proposes to construct a 10’ x 25’ addition to the existing industrial building. <br />5. The applicant has also proposed to add a second cremation machine to the business. <br />6. The Planning Commission and City Council reviewed the proposed Site Plan against the I-1, <br />Light Industrial standards of Section 6-060, performance standards of Section 6-390, and <br />parking standards of Chapter 11 of the Zoning Code. <br />7. The Planning Commission and City Council found all Site Plan standards to be met. <br />8. Zoning Code Section 6-050(2) allows approval of any use through Special Use Permit within <br />the I-1, Light Industrial, so long as the use is neither residential nor deemed heavy. <br />9. The Planning Commission and City Council reviewed the proposal in accordance with the <br />following Special Use Permit conditions of Zoning Code Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare.
