3

Commissioner Miwa suggested the Ordinance be reviewed in five years to see how temporary health care unit
dwellings are being utilized in the City of New Brighton.

Chairperson Nichols-Matkaiti supported the Ordinance being reviewed in five years.

Commissioner McPherson believed the revised Ordinance was well written and should move forward.

Commissioner Deick questioned if the City would be able to have communication with the companies that
provide the temporary health care units in order to have them removed in a timely manner. Planning Director
Gundlach stated there were not specific guidelines in place but stated staff would prefer to contact a vendor if
one existed as it would be easier to obtain compliance with a company verses an individual.

Commissioner Danger inquired how the City would manage the removal of a unit. Planning Director Gundlach
reported she would be relying on the City Attorney to draft the removal agreement.

Further discussion ensued regarding how the City would manage the removal of the temporary health care units.

Commissioner Deick anticipated that the majority of the health care units would be rented and not owned which
would provide the City with a vendor contact for their removal. He questioned how long it would take to
amend the proposed Ordinance. Planning Director Gundlach explained that the Ordinance would not require a
Public Hearing which means it would be a fairly quick process involving only one City Council meeting.

Commissioner Deick asked if any other cities were allowing temporary health care units. Planning Director
Gundlach stated, to her knowledge, that Osseo was one of the only communities that didn’t opt out of the state
statute so many other communities may be discussing local ordinances. She anticipated that the City’s
Ordinance would be reviewed by other communities in the metro area if they opt to allow temporary health care
units.

Commissioner Danger thanked Planning Director Gundlach for all of her efforts on the Ordinance and its
revisions.

Motion by Commissioner McPherson, seconded by Commissioner Deick, to direct staff to place the
Temporary Family Health Care Dwelling Ordinance Public Hearing on the April 18, 2017 Planning
Commission meeting agenda.

Approved 6-0.

Other Business: Chairperson Nichols-Matkaiti thanked Commissioner McPherson and Commissioner Deick
for their service to the City of New Brighton on the Planning Commission.

Adjournment:

Motion by Commissioner McPherson, seconded by Commissioner Deick, to adjourn the meeting.

6 Ayes, 0 Nayes, Motion carried.

Meeting adjourned at 7:41 PM
