<br />Noting the above, staff recommends approval of the Preliminary Plat to be known as NEW <br />BRIGHTON EXCHANGE 3RD ADDITION. <br /> <br />FINAL PLAT ANALYSIS <br />The applicant is also seeking Final Plat approval simultaneously with the Preliminary Plat. <br />While the preliminary and final plat is generally considered in two phases, it is not unusual to run <br />the processes simultaneously if the conditions are well defined and especially when the land is <br />vacant. <br /> <br />Section 26-41 of the City Code outlines the data necessary for approving a final plat. The City, <br />(as the landowner), E.G. Rud & Sons, Inc. (as the applicant’s surveyor), and Ryan (the <br />developer) have been working diligently to ensure all data is accurately depicted on the final plat. <br />Appropriate easements are proposed and appropriate land is being reserved for storm water <br />ponding, future development, and parkland. Already dedicated public right-of-way is sufficient <br />to support the development. <br /> <br />Lastly, Chapter 26 of the City Code requires payment of park dedication fees for any new lot <br />created at the time of final plat approval. The park dedication fee will be due prior to the City’s <br />release of the plat for recording. Park dedication fees in the amount of $13,180 / acre or $55,212 <br />will be due for Lot 1, Block 1, NEW BRIGHTON EXCHANGE 3RD ADDITION. <br /> <br />It is worth noting, the County Surveyor is still reviewing the plat. If amendments are necessary <br />to the lot layout as a result of that review, changes will be brought back to the Planning <br />Commission and City Council for approval prior to the actual filing of the plat. <br /> <br />Staff recommends approval of the final plat of NEW BRIGHTON EXCHANGE 3RD <br />ADDITION. <br /> <br />STAFF RECOMMENDATION <br />Staff recommends approval of the Preliminary and Final Plat of NEW BRIGHTON <br />EXCHANGE 3RD ADDITION, approval of the Preliminary and Final Planned Unit <br />Development, and approval of the proposed Site Plan, subject to the following conditions: <br />1. The property is developed in accordance with the Site Plan and Exterior Elevations and <br />Perspectives dated 5/9/2017 attached to this report and incorporation of all changes noted <br />herein. All other plans must be updated to reflect the Site Plan depicted on sheet C300 <br />dated 5/9/2017. <br />2. Any changes to the plans will be considered in accordance with Zoning Code Section 7- <br />260 and if considered “major amendments” will be required to be reviewed by the <br />Planning Commission and City Council after holding a public hearing. <br />3. The applicant enters into a Planned Unit Development Declaration and a Subdivision <br />Agreement prior to development of the site. <br />4. Construction must commence by August 1, 2017 (Commencement Date) and the <br />development shall be completed by December 31, 2018 (Compliance Date). <br />5. Incorporation of the recommendations of the Interoffice Engineering Memo dated <br />5/11/2017 and the Public Safety Memo dated 5/10/2017, both attached to this report. <br />6. The Plat is subject to review and incorporation of the Ramsey County Surveyor’s <br />comments.
